Pre-Assessed..
Hello,

I am sponsoring my common law wife for permanent residency. We are about 2/3rds the way through the processing time, but thanks to government backlogs it should have been finished by now(why am I not surprised). I am a Canadian and She is from mexico, and has had alot of homesickness these days.

My question is this , is there a way to apply for/obtain a re-entry visa so that she may head to Mexico for a couple weeks to visit her family??
It is my understanding that if she left for Mexico she may not be able to get a new visa to come back, and if she is unable to return the permanent residency application will become void.
Can we apply for a re-entry or multiple entry to Buffalo NY? even though we are both currently residing in Canada?

Thanks !! :D

I'm assuming you applied inland? Did she receive first stage approval? Did she get an open work permit? Does she have a job?

If you applied inland (Vegreville), it is highly risky to leave Canada, there is a chance that your application will be forfeited. If you choose to leave, then your spouse will need the visa to return to Canada.

If you applied outland, (to Mississauga, then through Mexico), then as long as your spouse has her passport and Canadian visa, then she is free to come and go as she pleases.

Hope that helps, and others may have other advice etc.

Yes we applied here in Canada.
We were supposed to get the first stage approval in May but immigration says there are backlogged and told us we should recieve the first answer end of this month.
So she hasnt received a work permit yet, and is not working.(although she has good qualifications and when legal to work shouldn't have any problem finding a good job here in Calgary)

I would wait until first stage approval and OWP is received AND she has a job. Then I would apply for a TRV before she made plans to travel. See what the result of the TRV application is and then the decision is made. Good luck.

Is there a chance that any of her family could come here for a visit? Given the risk of voiding her application if she leaves, it might be a reasonable solution to her homesickness.
