Pending aylum in the US wants to move to Canada

My children are 4 and 9 I am 31 and my husband is 34 he works in construction and remodeling bathrooms. No medical problems. And I’m working while I’m studying too. And I think everywhere is expensive to rent and no want families and they ask for a lot to rent.

Canada has a housing crisis and rents are sky high so you will find the costs for everything in Canada higher than the US. Have you figured out if you are eligible for Express Entry or PNPs to immigrate? What is your CRS score? Work permit is not an option.

Focus on researching immigration programs if you want to move to Canada. A work permit is not going to be approved for Canada with a pending refugee claim in the US.

Hello, I don't know if anyone has an answer to this question. Tried some lawyers who also don't have an answer. My question is can someone with a pending asylum case in united states move to Canada for work without any problems. I already have my Canadian work permit approved and pr application filed. My employer will want me starting work using the work permit while the pr is pending. Do you think I should head there now or just wait for my pr to be approved.

If you have an approved work permit, you should be good to enter Canada now. Ultimately it's your choice.

Make sure you're aware of the consequences of abandoning your refugee claim in the US and are good with those consequences.

I agree with @scylla's point above - but I would just emphasize that if anything should happen (like your PR application in Canada is refused and you can't extend your work permit, or some other scenarios), you would/could end up with the need to leave Canada and inability to return to the USA (the latter point probably obvious). Or without the ability to work.

Now, that 'need to leave' may not be automatic, but at that point, you'd almost certainly need a lawyer.

I have no reason to think this should happen, not trying to scare you, but this would be one downside scenario. If you feel confident enough and if situation is better than where you are, maybe the risks are small enough - I have no idea.

Would add that it is extremely unusual to be able to get a WP with an asylum claim open in the US. Although you have an approved work permit you could still be denied entry into Canada because you won’t be able to prove that you have strong ties to your home country and will return if you lose your WP. Safest way to come to Canada knowing you should be able to remain without issue is being approved for PR.

just an update. Went to canada. Passing through immigration was smooth. They were very friendly. Only asked where I will be working just for confirmation and my work permit was issued.

Yes you can get the required documents there. When you filling your PR form ,remember to put your status that you have a pending asylum case there. You will see the question on the form. I don't think there should be any problem
