PCC, question on Police Records - Someone please help !

Hello All. Here is my dilemma: :(

I had borrowed some loan back in my home country and I had issued checks based on my joint account with my partner, then I came to the U.S.

Though I had the money sufficient enough for the checks issued, my partner had withdrawn the money from my account and so there was no funds.

The checks got bounced, and a lawyer had sent summons to me and I was not aware of this. I am not sure if the bank had filed any police complaint on me during this time, I came to know about this case only last year and I duly paid the loan money and closed the bank account. When I had asked the bank through phone last year, the rep said bank didn't file any complaint but he told me as if he was not sure. So, I don't believe his words.

Now, I am not sure if this would appear as a criminal record when my consulate checks on my police criminal history for PCC (if the bank had filed any police complaint).

Can some one shed light please ?

Here is my thought.

When you apply for PCC, you get a document that says that a record is found or record not found. Basically you have to forward this to your legal rep if you have one or to the consulate yourself...I don't think in most cases that the consulate themselves will take the trouble of double checking every PCC. I am sure they might be doing some random checking.

I think you will be ok. If you want to be absolutely sure, get the pcc..open it and make sure they have given you a clean chit...then apply again for pcc from the same country and then submit the unopened PCC. I know this will take time but atleast you are sure that PCC will not be a reason for denial of PR.

Hi mtlguy, thank you very much for your reply. that really helps and soothing.

Your signature (or footnote) says you applied for India PCC on November 12 and Federal application on Nov 20th. did you get yours within a week ? or you didn't submit your PCC with the application now ? can we also do that ?

one more question. Can I get directly from India instead of going through the consulate ? any thoughts ?

I am going through the quebec skilled worker program...per my lawyer, for pnp's and csq we are allowed to file in the federal papers and then send the pcc as and when it arrives. I am still waiting for all PCC's.

I think the regular FSW is the only route where u need to have PCC when applying.

Yes, you are allowed to get PCC directly from India instead of going through the consulate if you find that more convenient.

More often than ever, the consulate route is faster unless you can pull strings in india. 8)
