As per me CHC, ND acted quite mature by sending back my passports because otherwise it would have been impossible for me to travel back to India and I would have to disclose the information to my employer as to why I cannot travel back. So, they in a way saved my job.
Now, my guess is that since there's neither an approval or rejection, there's no actual rejection. I'm and my wife have had 10 trips each overseas since we were 18 to various countries. So, as per GeorgeJoseph's analysis, CHC takes longer with such cases to clear security and now I agree with him.
What I'm going to do is -
Since, I'm reaching back India on Jan 11, I'm going to submit passports immediately after that without any case specific inquiry. and if they have an objection or rejection they'll simply send the passports back.
I won't need the US FBI clearance because the duration of stay is 4 months only.

@alok11 - where's the question of patience here...if I need to travel back, I need to travel back.. I cannot afford to stay in US without a US salary. Those who know me from the forum know that I was never impatient through the process and have helped several people through the process. But, maybe you cannot appreciate the position I was in. and BTW, holding the passports for 8 weeks is 56 days and 56 days > 45 days... I got the news and was naturally a little disappointed so shared immediately with the forum.
