Do you need to have your passport valid by the time that you get the visa issued ( PR)? Or is that possible that you have your passport expired and still can get the visa (PR) ?

They will not issue a visa into a passport that has expired, or that has less than 6 month's validity in the case of some countries. Your passport must be current for them to issue the visa.

ok. but if you were refugee claim and CIC has your passport and they don't want to give it to u... Do they issue a visa? or not? What you can do?

A visa is issued in your passport. And your passport must be valid.
If CIC has your expired passport you need to get it back and renew it before a visa will be issued.

Tried 3 times and the 2 first ones said no and the last one sent it 3 months ago and I haven't heard anything!!!! So i don't know what to do or who I have to speak to get it back....

Yes got first stage approval a couple months ago and just waiting for RCMP check polices and supposed to be the last thing to get the final decision
