Hi, i am now filling up my forms for a PR inland application as a common law . I've noticed that my passport still bears that i am married . .and bears the name of my ex. this is still the same passport i used to come in as a visitor. would it matter if i still use my surname or i would have to change the name of my passport to the surname of my common law?

You have to use which ever name is on your passport. If you wish to go back to your maiden name you must change your passport.
Its possible to submit the application, then get a new passport and update your application with the new passport details.
