Passport for dependent expiring

Hi all,

I require some assistance.One of our child dependents passports is expiring in July 2018 & we are unable to apply for a new passport as the other parent is not agreeing.The issue is with a lawyer but me and my partner have until May 25 2018 before ITA expires.

My question is, can we file in the meantime while we wait using the soon to expire passport in the hope that the legal process goes our way and we able to get a new passport? The lawyer that is handling our case has advised that we have strong case as the other parent is not involved in her life at all.

Yes - you can apply with the current passport and include a note stating that you are in the process of renewing the passport.

Note that you will need the other parent's written consent to bring the child to Canada.

Thanks for the reply.We are unable to get any consent from the parent hence the legal route.

A court order may get the passport (I can't comment on that but it sounds like your lawyer knows what he/she is doing) - however you will still need to deal with the issue of getting the other parent's consent to move the child to Canada. Recommend you spend some time looking for past discussions on this topic (you can use the forum search feature). I believe there are a number somewhere in the Express Entry and Family Sponsorship sections of the forum).

From what we understand the lawyer will also get a court order stating that the child can leave with us as the other parent is not active in the child's life at all - they looking to have the other parents parental rights suspended.Thanks again Scylla.I will also browse the forum, but your assistance is greatly appreciated
