I have a daughter from my previous marriage . We recently became citizens. I have got married again recently.Now I want to apply passport for my daughter. My current husband didnt legally adopt her. Does he become my daughter’s legal guardian by marrying me? In the application section of passport in other parent/ legal guardian should I input my current husband name ?

you need to put her bio dad because you will need to submit a birth certificate and also both parents signature on application. https://publications.gc.ca/collections/collection_2008/dfait-maeci/FR5-10-2007E.pdf

According to the pdf u provided, her bio dad doesnt need to sign. Regardless he is not in canada. And full custodian is myself

Only the parent with custodial rights may apply on behalf of the child. Where joint custody provisions exist, either parent may apply, but both parents must provide their consent by signing the application. Generally, both parents should participate in obtaining passport services for their child and sign the application form.

i clearly states u need both parents signature. under the Custody, separation and divorce section.. but you will more than likely need some kinda of consent letter or affidavit from her dad since he isn't in canda. but good luck tho
