Parents sponsorship, but parents divorced after approval, but live together

Hi!

I have a little bit strange situation here. I've applied in 2013 to sponsor for my parents - my mother and my stepfather. They were approved. But after that they divorced. And my mother moved to her homeland Ukraine and married there her "true love". After 6 months they divorced and mother moved back to stepfather. But they didn't married again and he doesn't know about her marriage in Ukraine. I know this sounds like soap opera, but true story.

So eventually they decided move to Canada in autumn of 2014. And they live in Canada (together) 10 months a year. But they didn't tell anyone about divorce.

The question is - what happens if officials find out about this? Will their PR be canceled? Do I have to make all the sponsorship stuff again? BTW now they are 50+.

Since this is not trivial situation, I couldn't fins answers searching forum.

Please clarify what are risks and what are possible options.

Need answers to a couple of questions before sharing my two cents
1. Date of landing- claiming their PR
2. Date of divorce- to see if by any chance, they meet the definition of common law by after the reconciliation before landing

All I can say is this constitutes misrepresentation as they are required to update the immigration officer any change to their marital status before landing. On the positive side of it, it is not a spousal sponsorship, which would be really bad. The focus of parent sponsorship application are financial requirement, medical and criminal issues. The problem in this case is, given they were divorced at some point and they were not together for more than a yr to be common-law partners before landing, one can not be listed as the accompanying spouse of the principal applicant. One parent would need to be removed from the original application and start another separate sponsorship.

It is my view that honesty is the best policy. Coming forward with an honest apology may not cause any problem, no one guarantees there is no consequences. The worst case scenario is CIC finds it out themselves. One of the consequences of misrep is five year ban from entering Canada.
You may want to consult with an experienced professional.

As I see if they don't report about divorce and officials find out the consequences are potentially really bad for both of them.

But if they report then possible bad scenario for one of them (my stepfather I guess) - to start separate sponsorship.

U can only sponser ur birth parents. Step father get visa based on him being spouse of ur birth mother. U could not have directly sponser him.

U can still sponser ur birth father.

Do you mean the PR app was approved and they landed as PRs in Nov 2014? This would be very quick processing (less than 2 years) for parents app. Also I don't think the parents stream was even open in 2013, it re-opened after long close in January 2014.

Or do you mean the PR app is still processing, and they are coming to Canada now on some other status?

You really aren't giving enough information for anyone to help you. What is the exact timeline of all events? When did they land? When did they actually separate?

Basically they should ALL keep quiet now and let things go as they are.
Don't involve CIC or they can all lose their PR status (because of misrepresentation).
Whoever has PR Card should live in Canada, or move back.
Don't even try any further "sponsorships" basically, or they all lose it (whoever has the pr cards) when CIC does investigations/checks.

this flip-flopping of relationships and true love does not go down well with CIC.

No matter the specific details, only thing for certain is they committed misrepresentation by not informing CIC of all the changes to legal relationship status. The husband should have been removed from the application as soon as they got divorced, and application should have continued with only your mom.

After she moved back with your stepfather, he could have possibly been re-added to the application as a common-law partner only after 1 year of living together.

However end result is your mom landed as married when she was not, and her husband landed as married when he may have not even qualified to be in the app in the first place. Lots of misrepresentation was committed here so if CIC ever finds out BOTH of them face revoking of their PR status.
