It doesnt matter if your spouse is a cosigner or not in your application, you need to count him in family size calculation.

Here is the statement from court for CIC

http://www.cic.gc.ca/english/resources/manuals/bulletins/2011/ob324.asp

On August 27, 2009, the Federal Court found in favour of the applicant. Justice Beaudry concluded that: “If an Applicant’s common-law spouse is to be considered in the calculation of the size of the Applicant’s family, her income should also be included in the sponsorship undertaking as per subsection 132(5) and paragraph 134(1)(c) of the Regulations. The statutory provisions do not provide for the exclusion of the spouse’s income while including her as a dependent member of the applicant’s family.”

Justice Beaudry’s reasoning was that CIC could not take into account the additional expenses incurred when adding a family member to the household, such as a spouse or common-law partner, without also taking into consideration the income that the individual brings to the household, if they have co-signed an undertaking.
So according to this, if spouse is considered as family size, his/her income should also be considered. From this, technically,reverse should also be true. Means if spouse's income is not considered, don't consider him/her in family size.

I am not sure, just assuming, up to you to decide. I would say, if you are not sure, take advise from a expert. Little knowledge always dangerous. It is very painful to go through when made a mistake while filing

There's no new form in December. CIC has changed the entire process to a lottery.

Please help, The copy of my parents marriage certificate( Translation document) was authorized two years ago. Should I got a updated one?
where did you get it translated ???

if it was done in Canada by a reputed institution & it has all the necessary stamps, it would be good for your whole life. But if it was done elsewhere in the world, I would suggest you to get is done in Canada.

A heads-up, 2017 PGP Applicants!

Changes to 2017 Parent and Grandparent Program application intake process

December 14, 2016—Ottawa, ON – Family reunification is a key immigration commitment of the Government of Canada. The Parent and Grandparent Program brings together thousands of families each year. For 2017, the Honourable John McCallum, Minister of Immigration, Refugees and Citizenship, today announced changes to how sponsorship applications will be submitted under the program.

In recent years, Immigration, Refugees and Citizenship Canada limited the number of parent and grandparent applications it would accept, in order to manage intake and interest in the program, and keep the number of applications from growing. Rather than the January rush to submit applications by courier or mail, those wanting to bring their parents or grandparents to Canada will now have 30 days to fill out an online form to indicate their interest. IRCC will then randomly choose 10,000 individuals from those who filled out the form, and those people will be invited to send in their complete application package.

The online form will be available starting January 3, 2017. Sponsors will have 30 days to submit the form.

Quote

“We’re listening to what past applicants had to say and making the process fairer for people who want to sponsor their parents or grandparents. We’re ensuring everyone can access the application process by giving them the same chance to have their name chosen.”

– The Honourable John McCallum, Minister of Immigration, Refugees and Citizenship

Backgrounder:

Changes to application intake process for 2017 Parent and Grandparent Program

The Government is committed to a fair and transparent immigration system. Changes made to the Parent and Grandparent Program will improve access to the application process, given that the number of applications accepted for intake is limited. In order to give the same chance to all Canadians who are interested in applying to sponsor their parents or grandparents, Immigration, Refugees and Citizenship Canada (IRCC) heard former applicants and is making changes to improve how people can apply to this program.

Between January 3 and February 2, 2017, Canadian citizens and permanent residents who want to apply as sponsors must first complete an online form on the IRCC website to let the Department know they are interested in applying to sponsor their parents or grandparents.

The online form will be available for 30 days, from noon Eastern Standard Time (EST) on January 3, 2017, to noon EST on February 2, 2017.

The form will ask for the individual’s first name, family name, date of birth, country of birth, main home address, postal code and email address. Once the information is successfully submitted through the online form, the individual will get a confirmation number. They should keep this number for their records. They will need to submit only one online form, as duplicate entries will be removed. Completing the form will not mean a person has applied to sponsor under the program.

At the end of the 30 days, IRCC will remove the duplicates, randomly choose 10 000 people and ask them to complete the full application. IRCC will let everyone who completed an online form know whether they were chosen or not. Only those who were randomly chosen will be invited to apply to the Parent and Grandparent Program.

Those who were invited to apply will have 90 days to submit their complete application to IRCC. The 2017 application kit and guide will be available on IRCC’s website on January 9, 2017.

Interested sponsors who are not selected will be able to indicate their interest to apply again in 2018.

Hi,

Thanks for information,

Not sure how fair is this also.

"Interested sponsors who are not selected will be able to indicate their interest to apply again in 2018."

How much the chances are to win a lottery in 2018 ?..

mmmm......

Can not think, what is happening ?

Why they just did not completely stop taking parents sponsorship applications?. This way it would be totally fair, and whoever is planning to coming to Canada has 100% clarity and fairness that he/she can not sponsor parents. No doubt at all and won't repent for their decision for whole of life

They are now just stretching it, the very least; they should limit it to only Canadian Citizens and have a FIFO basis not lottery.

Imagine if 30,000 people applied but didn't have the funds to proof it.

Whatever they are doing is = Fooling around people. Again whatever the way it is, it is just a try to show people "Oh we care about you and we think about human beings". As i mentioned before , why it is not easy just stop taking application for parents sponsorship. What is difference between completely stop taking application and this or that system (Limit to 5000/10000 or something like this) . I would put my self in shoes of a candidate who will never get a lottery or will get a lottery when one or both parents died.

As a immigrant, I would rather prefer to know very first day before emigrated that, "I am not able to sponsor my parents for whole life and I have to leave my parents by themselves alone for whole life" instead spending every year (moment) of my life to be get fooled around.

Even what is benefit of parents being here, rather the burden on health system and on our pay cheque.?

I did not go through the documentation for new system, but i am sure they will allow you to apply, if some of from lottery system won't be able to prove income. May be have waiting list or so.. But who knows... They can do whatever they want.. They know we are NOT able to protest :) :(

Interesting story, Few years back , i had joined honey bee keeping training course and found. In a honey bee colony

- One bee queen
- 80-90 % bees are workers
- 10 % or so Drones. From Wikipedia https://en.wikipedia.org/wiki/Drone_(bee) definition "Drones do not exhibit typical worker bee behaviours such as nectar and pollen gathering, nursing, or hive construction."

I like the change.

Previously, people were forging signatures of their parents on the forms in order to beat everyone else, and the courier companies were also taking advantage and charging so much money just to deliver to CIC early, on time etc. Then you had people stressing out about whether their application made the 5k/10k intake or not.

With this new online application, EVERYONE has a chance to be selected. Not just those who forged/faked signatures and documents and rushed their docs on 1st day by paying extra $$$$.

I like the change, its more fair and gives everyone a better chance even if they're few days late. Plus it prevents couriers from playing with people's emotions and charging them so much money just to make a delivery. Courier companies got greedy, well, it didn't last long for them. I like that.

People will probably still forge docs/signatures but atleast the "rush to get it in" will subside. People will calm down a little and not be so stressed.

I agree,

Also, it would be great if they can make another change, The change should be for those who did not get chance this year, should be given priority/Guarantee for next year. Other wise, think about some one who never get select for whole life. I know, some one may say "oh... this is not possibility." This is possible. I am not sure, about this if this type of provision is already there ..
I believe Minister and people at CIC getting huge pay as a salary, they are Smart people, get selected on Job through a selection process and may have already thought of it...

Apart from this, all looks ok.. also as long as lottery system is transparent...

Hello dear forum members, first of all I dont know how how can I post something without clicking quote. Can someome plz tell me? I mean where do I click to start a new post/ topic.

Now coming to my problem which is really bothering me and has confused the hell out of me. Few days ago I mentioned that I contacted my local mp MP to give me an update about my parent sponsorship file. I got the reponse saying that the immigration has recieved DNA results and that they are assessing it. The problem was that we never did any DNA test! When I protested and told MP about it she asked me to wait till she makes further inquiry. Today she replied back forwarding the following message.

(Thank you for contacting the Information Centre for Members of Parliament and Senators.
Following your phone enquiry to the Information Centre for Members of Parliament and Senators on December 2nd, 2016, we received the following answer for the Sponsorship of Parents and Grandparents enquiry for your constituent:

“We have no record of receiving a request from the lab to conduct DNA sample collection for the applicants. Grateful if your office could advise the sponsor to contact the lab in order to initiate DNA procedure.”)

What does this mean??? Why should we go to lab to initiate DNA test? I dont want to do any voluntary DNA test. Its an expensive procedure and I have my mom and siblings on file. I always thought that CIC requests DNA test if they dont have enough proof to establish relationships. There is no update on Ecas after the medicals were sent , no correspondance....can someone please advise me what does this mean? Should we do DNA test or should we wait for visa office to send us DNA request?
This is so confusing....any help/ideas would be highly appreciated. Thanks!!

Hi,

You can start a new post by clicking the "REPLY" button/option at bottom right corner of last post. It is also available in top right corner of PAGE as well. But i never tried that. I always use the the "REPLY" from bottom right corner. This is one of the four buttons/options in bottom right corner. REPLY| NOTIFY|SEND THIS TOPIC|PRINT

For the other option, i had mentioned before, and sorry to repeat again don't go to MP office. I know, you are thinking how the MP office can give you such misinformation and confuse you. MP office is so responsible etc. etc. etc. etc... It is not true... at least i can say from my experience.

Lets suppose even MP Office is giving you correct information, I don't think you should act or do DNA tests, just bases on information from MP Office. I would say call/email CIC office and confirm. Only then go for test or something if CIC had asked you. Please correct me if i am wrong, You need some document from CIC to go to Lab to do DNA. E.g for regular medical, Doctor/physician won't do medical without the letter/medical papers from CIC.

I believe same is in this case. Even if you would try to go to Lab for DNA. People working in Lab would ask you for document from CIC to do the test. you can confirm by calling such lab..

I hope it would be helpful

Here is more information about DNA tests

From the CIC manual http://www.cic.gc.ca/englisH/resources/manuals/op/op01-eng.pdf

In this manual from Section 13 Procedure: DNA tests

========================================
13.1 Information for applicants
Visa offices should inform applicants of the following:
 the decision to be tested or not is entirely their own;
 they or their sponsor must pay all costs, including sample taking, courier costs for
shipping, the laboratory analysis of all samples, and the final report submitted
directly from the laboratory to IRCC and the applicant;
=========================================

In this manual from Section 14 Procedure: DNA testing

======================
The following steps must be followed when samples for DNA testing are taken:
Provide clients with the link to the Standards Council of Canada website that
provides names and addresses of laboratories accredited for DNA relationship
testing. Applicants, their sponsors or representatives are responsible for choosing a
laboratory.
=======================

Finally a sample letter

=============================
Appendix D Sample letter requesting a DNA test (to be adapted
to your needs)
[Date]
[File number]
[Name and address]
Dear [applicant]:
This refers to your application for permanent residence in Canada.
Include the following paragraph if no documentary evidence is submitted in
support of the application.
After reviewing the information provided in support of your application, I am not satisfied
that there is sufficient evidence to prove the parent-child relationship between you and
[NAME OF CHILD].
Include the following paragraph if some documentary evidence is submitted but is
not satisfactory. Add brief reasons for suggesting a DNA test as well. Sample
reasons are listed below.
After reviewing the information provided in support of your application, I am not satisfied
that there is sufficient evidence to prove the parent-child relationship between you and
[NAME OF CHILD].
 The birth certificate you provided was issued after you submitted your application for
permanent residence.
 The birth certificate you provided was sent for verification to the (name of the
authorities). [Name of the authorities] have confirmed that the certificate was never
issued by them.
Since the documentary evidence you have provided does not enable us to establish
parentage between you and the child, and you are unable to obtain other documentary
evidence, in place of documentary evidence we will accept the results of a DNA analysis
carried out by a laboratory accredited by the Standards Council of Canada for DNA testing.
You are responsible for the selection of such an accredited laboratory in Canada and for the
costs associated with sample taking, shipping, laboratory analysis and report submission.
Please refer to the list of laboratories accredited by the Standards Council of Canada to
conduct DNA testing.
Once you decide to undergo DNA testing, the chosen laboratory will send us a letter
informing us that you are prepared to undertake testing. Upon receipt of this letter, we will
OP 1 Procedures
2016-03-15 80
then contact you with a date for sample collection at an [APPROVED COLLECTION SITE]. We
will also inform you of the requirements for a valid passport, an identification card, two
passport-size photos, and the fees for the sample collection procedure and courier services
to send each sample to Canada. Please note that it is important for you to have on hand the
necessary identification documents so that we may proceed with the sample collection.
The results of the DNA tests will be sent to us by the laboratory when analysis has been
completed. This can take approximately four to six weeks.
If the tests confirm the relationship between you and [NAME OF CHILD], we will be in a
position to proceed with the processing of your application or issue new medical instructions
if your medical results have expired by that time.
DNA tests are not mandatory.
If we are not advised within 90 days by a laboratory that you will undergo DNA testing, we
will assume that you are no longer interested in providing a DNA test result and will render
a decision based on the information available to us at that time.
Sincerely,
[VISA OFFICER]
A list of accredited laboratories can be found on the Standards Council of Canada website.
=========================================================

So from this CIC manual, my understanding is that, CIC should inform the client (in this case You) about the test and all other information with the letter as shown above. I don't think it is something you can just go by your self and do the DNA test

And also without information from CIC, how you would know, which person should go for DNA test, e.g. you and your mother or Your sibling(which sibling) and your mother should go for test.?

Also here is link for DNA test labs in case you need to call DNA labs to confirm if they can do the test with CIC letter ?
