Now is the time, I would talk to a good immigration attorney

Hi All

Need suggestions on what I can do next to make an appeal to re-open my PGP 2024 application.

I submitted by interest to sponsor my parents under PGP in 2020. Received invitation to apply for PGP in 2024. Applied to PGP in July 2024. Received email about missing information esp. following :

IMM 5669 (for Principal Applicant)
IMM 5406 (for Principal Applicant)
Resume (for Principal Applicant)
IMM 5669 (for Dependant)
IMM 5406 (for Dependant)
Proof of Relationship to Principal Applicant
Resume (for Dependant)

Submitted all required information within 30 days through email in Dec 2024. However, suddenly in Jan 10, I received am email from IRCC that because the 30 days have to submit the information, they are closing the file and mentioned following are missing :

- [PA] IMM 5406 (for Principal Applicant): Incomplete
- [PA] Resume (for Principal Applicant): Incomplete
- [DEP] IMM 5406 (for Dependant): Incomplete

No other details on what is missing since I already submitted them. So, I called the IRCC call centre but I made a mistake to not submit Representative form so they did not give me any details. I submitted IMM 5476 through IRCC.CPCMParentsandGrandparents-Parentsetgrands-parentsCTDM.IRCC@cic.gc.ca

I called thte IRCC call centre again last week but disconnected due to large volume. I will continue to call this week for follow-up and getting additional details esp. an appeal to re-open the file so that I can get a chance to submit missing information.

Has anyone has similar case ? If so, were you able to appeal and re-open the file ? Did you hire a lawyer or Immigrant consultant etc. ? TBH, I am lost and not sure what I can do next. Any suggestions would be highly appreciated.

Next time when you call IRCC, if your parents are with you or you can have them in conference with the IRCC officer and then just just simply ask your parents to provide consent over the phone to release the information to you. I did the same thing. Even though I had submitted 5476, still IRCC did not considered it. But the agent said, if she can talk to my mother and have her give the consent over the phone then she can release the information to me and I did that. IRCC agent asked a few basic questions and thats it. Try that tomorrow. Otherwise, submit 5476 or contact attorney at the earlier. Even for Attorney to take over, they will have to submit 5476 with your parent;s signature.
All the best,

For those who have done medical test for their parents, what type of test/exams did they go through?

My Mom had cancer 10 years ago but she is ok now, do you think that will cause any risk in there application? She is not the primary applicant, my dad is.

Thank you!

You might want to look into procedural fairness letter for medical inadmissibility. I am unsure about probability of this happening. You might want to read more here:

https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/inadmissibility/reasons/medical-inadmissibility.html

https://www.canadavisa.com/overcome-medical-inadmissibility-to-canada.html

You could contact an immigration lawyer with experience dealing with these cases to prepare a response to a procedural fairness letter in advance

I received the biometrics request for my parents today and the request letter for my mother has her name wrong.
Instead of
Given Name: First Name
Family Name: Last Name

they have it as
Given Name: First Name Last Name
Family Name: FNU

Should I ask them to go ahead with the biometrics or reach out to IRCC to correct it? If they have to correct it, should I be expecting a new biometrics request letter with the correct name?

My father who is principal applicant on the file suffered through brain stroke a month ago and now his right hand is affected. In between, I received additional document request to resubmit IMM5406 with signature.
I am thinking to get thumb impression and write a letter of explanation to mention the situation. Is there any other suggestion on how should I submit IMM 5406 for my father?

Thanks
