papers on process - 15 days before grace period of 90 days ends - how is it???

to all knowledgeable please share...

someone ask me re:

grace period of 90 days is ending by july 31 2012. on the 15th of july lmo finally released and filing of application on restoration and new wp is filed by 18th inside canada. for sure the processing will surpass the grace period as end month of july.

1. is the person needs to go outside canada because grace period soon to end and wp is not issued yet whether positive or negative result?

my answer is no to the person asking me and now i am sharing this question to anyone who can explain further. this will help our dear peeps who seeks the same question to be answered...

please shed and participate...thank you!

No, he/she can stay until a decision is made. It would be wise to keep a copy of the fee receipt in case he/she needs to renew their healthcard.

Yes the applicant can stay till s/he receives the decision.

Well, it is on paper but as I found out, they will extend your health coverage for 90 days while you await a decision on your work permit. All you need is proof(i.e. fee receipt) that you've applied.

to senoritabella,

as i analyze what i read from your input, an msp and right to stay (not anymore out of status) becomes implied too once a restoration and new work permit with approved new lmo is filed then on process. it will only ceases as implied status when a new wp is denied or not approved.

to sum it up implied status is not only for continuity of work for the same employer waiting extended wp.

implied status is also applicable to all who filed restoration and applied new wp with approved new lmo. that while waiting for the new wp if someone wishes to continue msp services it can be done by informing and requesting service canada. once approved, pay for the dues then msp is reinstated.

is implied status waiting for new wp with restoration is also effective going u.s. (u.s. visa holder) then re - enter as is (trv expired on passport)?

Implied status => if one has managed to send the application for the new WP (same employer, no changes on the job description), before the expiration of the old one. Once the person has lost the status (new WP application refused, but still within the 90 day restoration period), the applicant must stop working. Once you have sent in an application for the new WP/restoration, you are not on implied status as a worker though you can stay and wait for the decision.

With an expired TRV and WP one won't be allowed to re-enter; out of status. Even with an application for restoration of status submitted, there's no guarantee that one can't be asked to leave Canada.

thank you job_seeker,

for straightening up, implied status only take effect when an applicant who files an extended wp for the same employer within current status happen to be surpassing the expiry date of current wp while waiting for the extended wp to be issued - no more, no less to apply for anything but only in this premises.
