So, I am allowed to have 2 weeks of paid vacation per year at my job. I tried to use some of my vacation time but my boss is unwilling to give it to me saying we are too busy. If a take a day off, he makes me work off the clock for free, he makes me work the time I took off or at least some of it on Saturdays for free.

Now, I informed him about my situation, my post graduate work permit expires in May and I am stuck in EE in low 400. So, he is well aware of the situation I am in and he is officially proceeding with LMIA but not really.

So, my question is.. If I quit my job because of the expired WP, will he pay me for the unused vacation time? In my homecountry, if you quit a job and you haven't used your vacation time, you'll get paid for it. I am not sure if it's the same in Canada. I would greatly appreciate if someone could give me any information on this cause now I have a feeling that I'm being taken advantage of and that's not fun. :(

You are supposed to be paid for any accumulated vacation hours and banked time if your employment with a company ends. The only exception will be if you get your vacation paid out on every pay cheque.

I work in a HR type role and this is the policy in my company and I would assume for Canada.
