So everyone I can't do this any longer the wait has only been over a month but too terrified. We are packing up and leaving and try living in Europe as my partner is not allowed to even visit the UK. I can't live waiting to see if I will be removed. Thank you to everyone for there help. Ponga u have been amazing and cunuk_uk a star. Thank u guys and good luck everyone

I can't believe you did this for me thank you. I was too scared to do it. So this is a little reassurance but I am in the wrong staying and my son I can't bare the thought of anything happening to him. You have been amazing. Thank u so much. Good luck.

Given that you applied outland and your partner is Canadian, I would suggest you just let the app process. You guys can be outside of Canada while the app is processed without issue. Once it's approved, you can make the decision whether to return or not.
 
Unfortunately I withdrew my application I was so afraid I couldn't take it. Back to square one I am afraid. Thank you again though Canuck in UK u have been amazing

I would suggest you try to withdraw the withdrawal. Explain something like "I didn't know that the PR app could continue to process while we were outside of Canada yada yada". You just leave your options open by letting it process.
 
The only thing is I am selling everything I own so if I leave I leave. No coming back. A few questions though how does CBSA find out of the overstay is it through cic or is it because of something I would do in order to get caught ? Also how long does first stage of the inland take? The one thing I feel I can't wait around for is health care I feel very insecure without it. Working is not an issue I am a stay at home mom and will be for a couple of years.
 
I would honestly try and wait it out. I know it is hard but honestly if you just go about your life and focus on things not related to the PR, you can probably get through it.

I would recommend trying, even though I don't know about your specific situation, I do know you shouldn't give up. there is always a way around every situation... (Someone made a passing remark earlier today about how conjagal bypasses many things, that matter for spouses, and it got me thinking, conjagal may be a way to bypass an exclusion order -- granted I haven't looked into this).

That said, I wouldn't worry about getting kicked out. If you don't have a departure order currently, being out of status may actually work in your favour. I believe I read something about a PR app being expidited (to the tune of a few weeks) because CBSA was ready to issue enforcement action and instead made a inquiry to CIC and request to expidited while delaying enforcement.
 
Yes, this is 100% true...I know because CBSA asked me if I wanted them to ask CIC to expedite processing of my application...I refused because at the point my application would have been refused...so I opted for prra to buy some time and to sort things out...well mainly my husband's family maintenance arrears....but yes CBSA will give you some options...Its not like they catch you and throw you on the next plane...its not like that at all...I know, I've been through it :)...

There you have it, Help22, I would recommend you try and contact CIC and withdraw your withdrawal. Just wait it out, I am sure you will be fine.
 
Hey guys so I read your messages a million times violet blue I know u managed and I know what u went through but there is just one thing always on my mind do I have to do something in order to get get caught or do cic tell them. I know they don't work together. The reason why I am so concerned is I am so aware of what I do outdoors i don't drive I am extra nice to people I walk on egg shells I am rethinking my application I am 80% there. U guys are awesome thank u
 
The question that still remains unanswered (anywhere)...is what does CBSA do if the person has chosen to submit an OUTLAND application!

The Outland application is usually much faster, but most cases (including VioletBlue) are applicants without status that submitted an Inland application, because of the certain level of protection that it gives them. The language in IP 8 indicates that a person without status may benefit from the Public Policy (not to be removed) if they have an in-Canada sponsorship application submitted prior to being deemed removal ready. This means an INLAND application, not Outland. If an Outland applicant really does have the same level of protection (or at least no less), then why on earth doesn't CIC and/or CBSA have anything in writing in any other publication, or Operational Bulletin, to discuss this? Surely they realize that a person without status in Canada can still submit an Outland application.

Knowing what the additional consequences could be, would help a lot of people.
 
I understand ponga it's risky. Violet blue had no application submitted when they knocked on her door. She then submitted it 3 weeks later. How long does AIP take for inland ? Yeah it's very confusing

AIP for an Inland applicant takes ~ 15 months now.

It's clear that CBSA does NOT have a cookie cutter model in place for how they handle people that are in Canada without status. VioletBlue was certainly one of the lucky ones.

You really have to think about your quality of life, and that of your family. If all you're doing is `hiding' in your house, afraid to really be out in the real world...you have to ask yourself if that's really the best thing for you AND your family. It's good that you're not driving because if you were to be stopped and the officer started asking about your immigration status in Canada...things could get bad very quick.

I strongly suggest...even beg you, to have someone contact CBSA (anonymously, from a public phone if needed) on your behalf and explain what you've done (submitted an Outland application) and see what they say. Maybe...they'll say something like "Since she has taken steps to resolve her immigration status, we will `watch from a distance', blah blah blah..." Even if they say "She really should have submitted an Inland application", at least you'll know something...something from the person/agency that can give you an honest answer.

Please do this ASAP!!!
