Hey Guys / Seniors,

As the topic title summarizes the situation; what if the Spouse 'declines' to move to Canada, wherein the PA & his Kids 'land' & return back to try and continue mitigation. But, eventually do not succeed in convincing the wife, while the Visa/s yet remain 'valid' for a couple of more months.

What are the Dangers?
1. Do the PA need to 'notify' CHC/CIC?
2. Is there any adversity to the case?
3. Does it pop-up any 'red flags'?
4. Basically, what to do*?

*No, not about the family front, obviously it's a tragedy -'Alice is stuck in the deep-deep Rabbit hole' for the entire lifetime, but 'what to do' in respect of the PR Immigration/Citizenship, Accountability, Reporting to Authorities [if required] etc.?

Plz advice...

It will have no effect on others ( main applicant and kids ) if spouse declines to move to Canada. No red flags for this can be raised by anyone. I dont think CHC / CIC is to be necessarily informed.
 
It will not be a problem. The wifes visa will expire and she will no longer be able to land as a PR. The husband and children can go on with their life in Canada although if the children are minor and if there are custody issues, that can cause a problem with where the children should live.

If the wife later wishes to get PR (crawls out of the rabbit hole), the husband can sponsor her for PR but it will take at least a few months to get it through, maybe a year. It really should be explained to the wife that she is slamming a door shut instead of keeping it ajar. She only has to go to Canada and land. Then she can go back to her country and think about it for another 3 years before she would lose PR due to residency requirements. Instead, she is slamming the door shut and if she changes her mind in a year or two or three, it will be a lot more hassle.

Yes there is no effect if the wife does not wish to migrate for whatever reason.

Only issue will be custody of minor children if she does not want them to move to Canada

Dear Leon, that was encouraging. Hope 'Dorothy' doesn't kiss a permanent good bye & comes to her senses... and eventually all gets well.

It was indeed a solace to know that there wouldn't be any procedural mishap -on the immigration front.
