OWP & procession time myth for Inland application

Hi Everyone,

I sent out an inland application to sponsor my husband on Feb28,2014 ( Delivered to the CIC office). I understand that it takes 15 months for stage 1 & 8 months for stage 2 to process. And now they are still processing those applications in Aug 2013. So is that mean my stage 1 will only be started after the website reflect "processing Feb2014 application".

I notices some other posts mentioned that once they recieved their AOR, the eCas should update the status as
"We recieved your application on Feb/XX/2013. And we start process your application on May/XX/2014"
Does this mean they just start doing stage 1 on May 2014? or they start doing the stage 2 on May 2014? ( which assume the sponsorship is approved)

My husband's 3-year post graduate work permit is expiring in July 2015. If I didn't submit an OWP for my husband with my sponsorship inland application, is there any way I can submit now? does it make any different if he applys the OWP after the stage 1 approved? Is there any other way he can extend his current work permit?

AOR isn't stage one approval. It's just a notification that the application has been received. AIP is first stage approval. So to answer your question, it means they started working on stage 1 of the application on May 2014.

Unfortunately you cannot submit an OWP now. You will have to wait until your husband has first stage approval (AIP) before you can submit the OWP.

If he does not have AIP by the time his PGWP expires, then if he wants to continue working, his employer will need to obtain an approved LMIA and then he will have to obtain a closed work permit.

Thanks Scylla. So the application would prob take more than 2.5 year to be completed if they are still processing the Aug 2013 application. That's disappointing. If we already applied inland, and it is not even processed when his work permit expired, can he stay in Canada for that period of time?
And I thought the inland application requires the applicant stay in Canada. This inland process just doesn't make sense that it took so much longer than outland application.

Since he didn't submit an OWP with the inland app, he does NOT have implied status in Canada. So when his PGWP is about to expire he must apply to turn that into a visitor status (or can try to arrange for closed work permit as mentioned above). If he just lets the PGWP expire and does not apply for any other status here, then technically he would then be in Canada illegally.

And I thought the inland application requires the applicant stay in Canada. This inland process just doesn't make sense that it took so much longer than outland application.

Yes the applicant should stay in Canada, but should also have valid or implied status here.

I'm not sure why you're surprised at inland processing times, as the inland guide actually states to expect a slow processing time, and to apply outland instead if possible to get quicker processing:

so applying inland means your application would have been approved? how so?

at least you had the right to appeal with an outland application. you don't get that priveledge with inland.

If they denied the visa the first time, then yes, likely you still go out of this easeir and faster than if you'd kept inland. Why and or how you ask?

Well, you would've had to wait out the entire Inland time frame (for 2009 applicants) only to find out your partner was denied the visa. Partner would then have to leave the country and you two would have to gather all the documentations necessary again, then pay the fees again then apply again and wait to see if it was then approved. If it was not approved, then you would have to do an appeal. That would certainly add time to the process. It really is a moot point now, obviously, since your partner has landed, but why did your partner leave in the first place? You can remain in Canada and file an outland application, you just have to continue holding a status while you remain.
