OWP for my spouse

Hi,

I need some help please.
I am currently in Canada as a student. I have got married this summer and I want my husband be with me while i'm in Canada, since I have long way to go.
We applied for a online TRV this month and got a rejection (saying that he does not have travel history and he did not satisfy them that he will leave Canada). Now we want to apply for OWP, but i am not sure here... Should my husband apply for as a primary applicant from backhome or I could apply for OWP for him, since he is a dependant in this case.

It is his application, he has to apply. If he has been refused a TRV, you probably can expect that he will be refused an SOWP.

I am sorry but I feel opposite of this. Initially you should have applied for his OWP and he might have got it by now. They do not give TRVs easily cause they feel that people will not return back and will work illegally in Canada. I would strongly suggest you apply for his OWP now and he should definitely get that until your Study Permit is valid.

OWP is as difficult as TRV . It all depends on the spouses profile. My experience is TRV are a bit easier but again it all depends on spouses profile. What good is OWP if the spouse is not qualified to get a job. example spouse has no job experience , bad grades etc. VO will look at the complete application eg. what experience spouse has what education spouse has , if spouse is unable to find employment will they be able to sustain both of them together etc. I completely agree with PMM's assessment unless the reasons for TRV refusal are addressed its difficult to get OWP too.

I am pretty sure the VO was aware that the applicant had a spouse in Canada and was going to qualify for SOWP.

The truth of the matter is that a lot of intl students these days have no intention of studying but come over to secure OWP for the more credentialed and qualified partner and CIC is increasingly clamping down on that

The problem is that now I'm in Canada, and he is at backhome. I'm not sure how I could apply, where should I send the application, Canada or Moscow(in my case)?
I wish I could apply for him, since I have travel history, reasonable status in Canada, etc.. while for him it's the first time and CIC gets suspicious on this

I am assuming u already have a study visa/permit.....and since u have visa how can u be a primary applicant that would mean ur applying for visa again? if u were applying for visa then u can add ur spouse as accompanying you and apply for ur spouses TRV/OWP along with u primary application. In your case now ur spouse has to file as a primary applicant and add ur study permit and other documents as supporting documents as a proof of his eligibility criteia for a OWP.

Regarding to his profile... he has a very good profile- high education, a good job at backhome, so I think he can easily find a new job in canada if he gets OWP. We just want to be together while i'm here.

did u attach all these documents(about good job back ground,education) when applied for the first time and also did u show enough funds to support u both in canada?

yes, we had reference letters, enough money on his account.. about education we wrote in the application, but we did not attach his diploma certificate, maybe we should have done that too. Though, they could ask if that was the problem. They said he does not have travel history and they are not convinced that he will leave canada in a few months.
Now for OWP the second argument should not be, since he is coming to stay here as long as i am here, but i'm worried about his travel history.
