Outland while living in Canada?

Hi guys I have two questions and really hope someone will have the knowledge or experience to answer them.

I am currently in Canada and about to submit my spousal application. My common-law partner is sponsoring me and we have everything but: Where to send it?

Since I am in Canada and have an open work permi (working holiday visa) for another year and a half, I don't need to apply for the open work prmit you get after 4 months.

A friend of mine applied to our home country before the changes and got her PR in 4 months. So I was wondering if I should do the same and send it to Vienna. Am I allowed to do so?

- If I am allowed to do so, is the address PO BOX 3000 Station A, Mississauga, L5A 4N6?

Also, does any one have been able to link their application to their MyCIC account? If yes, do you know how long it took you?

Thank you for taking the time to read my request,

Regards

Hey there,

Regarding your application I would probably consider applying for the Inland Canada Application. It would make a lot more sense to do so as you are already residing in Canada with your partner.

Both Outland and Inland Canada applications are due to be processed within 12 months instead of 26 months as previous, this was changed as of December 2016.

Honestly up to you as to whether you would like to apply for Outland or Inland Canada. With Outland you can appeal immigration decisions where as Inland you cannot.

I have linked my application to the My CIC and it didn't take long at all, was a very easy and simple process.

Good luck with your application!

It is not really a question of 'where to send it' per se, it is a question of whether you want to apply as inland or outland (yes, you can apply as 'outland' even though you are living in Canada). There are pro's and con's to either. Overall processing times vary by the nationality of the PA and whether you apply inland or outland (you haven't stated your nationality). Start with a read here (one of the snags of inland is that it is unwise to leave Canada at all while your application is in process):

http://britishexpats.com/wiki/Spousal_Sponsorship-Canada

The forms and attachments required for both inland and outland are now the same. Which you apply for is determined by how you answer the checklist question / item for Sponsored Person - Item 4. Read here:

http://britishexpats.com/wiki/Spousal_Sponsorship-Canada/FAQ_-_New_Application_Forms#Sponsored_Persons.2C_Item_4_-_how_do_I_specify_inland_or_outland.3F

Yes, there are separate CIC PO Box addresses to send the pack to depending on whether it is inland or outland. However, note that IMHO you would be well advised to send your pack by courier and get it signed for. If you do that, then there is a third address to use which is the same for either inland or outland. See here (Step 7):

http://www.cic.gc.ca/english/information/applications/guides/5525ETOC.asp

YOU do not 'send' it to any particular Visa Office and you cannot influence where they send it. You send the pack to CPC Mississauga (as per the above link). CPC Mississauga do the sponsor approval step. Once this is done, CPC Mississauga then decide which VO to send it onto, usually (but not always) based on the VO that applies to the nationality of the Principal Applicant (e.g. for a Brit, they may send it to London UK or Ottawa).

You can try to link to a MyCIC account a couple of weeks after arrival of your pack at CPC Mississauga, but may have better luck to wait for them to acknowledge your application or when they first advise you of your UCI and Application number, which can take 2 - 8 weeks.

It most definitely does NOT make more sense for OP to apply inland. The only real benefit to applying inland is the OWP; as OP already has a work permit that is valid for another year and a half, there is no need to apply for another one. An outland application is a far better choice.

No, it really wouldn't.

If they apply outland, it will almost certainly be quicker. Although inland apps are supposed to be speeding up, they are unlikely to come through as fast as a lot of European outland apps are processed now.

If they apply outland, they will have the right of appeal if refused. Inland apps do not have that right.

If they apply inland, they qualify for a work permit - which they already have, so do not need.

If they apply inland, any interview required will be in Canada rather than home country. This is the only advantage that inland has in this situation. However, if OP is French as the username and other posts imply, then an interview is extremely unlikely (as a French person gains very little, if anything, economically or socially by moving to Canada, so is probably less likely to be faking it for those gains).

That said, OP posts today that they are about to submit an application, and 8 days ago they posted that they had submitted a spousal application some weeks ago (http://www.canadavisa.com/canada-immigration-discussion-board/threads/inland-canadian-police-check.490072/), so goodness only knows what their story is.

Do not apply inland. You don't need to. You're right to apply outland since a work permit isn't necessary for you.

Hi, planning to apply outland while i am visiting my spouse here in canada. We also plan to travel out and in of canada during the process. Which could be the best option for us?

I am currently living outside Canada, and I am applying under the Family Class.
Or
I am currently living in Canada, and I am applying under the Family Class (not under the Spouse or Common-Law Partner in Canada
Class). I understand that I may be convoked to attend an interview at a visa office outside Canada

Looking at them has the same mailing address, just confused which one allows travelling out and in canada.

Both of those options are outland. The first is if you are not in Canada and the second is if you are in Canada.

hi, sorry for another confusion....saw this on the cic website, highlighting in bold their note

Application for spouses, common-law partners or conjugal partners and dependent children (currently living outside Canada):
CPC Mississauga
P.O. Box 3000, Station A
Mississauga, ON
L5A 4N6

Note: Choose this option if your spouse or common-law partner is living in Canada with you, but doesn’t plan to stay in Canada while the application is being processed.

So, with this did they mean option#2? on the Class of Application?

I don't understand the confusion. The note clearly states to use that address if you are in Canada and applying outland.
