Outland through Buffalo

We have applied outland through Buffalo. One of the questions was for an interview what location we would choose; we put NYC.

My question is, to LAND, would that therefore be thorugh NYC as well, or is was that just if there was an interview?

I'm just curious about landing if you live in Canada but are applying outland.

NYC will process your file. If there's an interview, it will by in NYC. Once you get the PR visa, you need to land in Canada, not in NYC. Pretty much anywhere in Canada will work except Quebec unless you are applying from Quebec and have their selection certificate.

Actually we asked that the application is processed in Buffalo. Buffalo was not an option for an Interview location, so we selected NYC.

Since my husband is already living in Canada with me, to land, does he need to leave the country and then come back?

He can request a landing interview at the local CIC office but it might take longer to get that then going to the border and doing a flagpole landing :)

When he gets his PR visa, you can go to your local CIC office and ask if they let him land there. Otherwise you can change it to a vacation or if you are close to the border, just take a drive.

Actually you have to phone the call centre to make an appointment for "landing" at your local CIC>

An outland applicant can land at any Canadian port of entry. The option for outland applicants to land at local CIC offices is new - so there's no real indication of how long such an appointment would take to get. Local offices are also tasked with "landing" inland applicants, so unless you're prohibitively far from the US/Canada border, it's probably a lot faster and easier for you to simply make a quick trip across the US/Canada border, and then re-enter Canada and "land" at the port of entry.

If we just made a trip to then turn around and re-enter, would you say that's your purpose of your trip to the US? Also, do they only allow "landing" during certain hours?

You don't even have to enter the US if you don't want to. It is even possible for people who don't have visa to the US to do this. You just say when you get to the US side that you don't really want to enter the US, you just came to land as a PR of Canada and they'll turn you around so you can do that. I don't know about hours. You can find Canada Border Services at http://www.cbsa-asfc.gc.ca/menu-eng.html If you follow their "contact us" link, you can ask them about certain border stations and if they have certain hours only.

what if you need an interview and you don't have visa to the us? i'm considering to withdraw my inland and just do outland. what would be best to do? if it takes years to process inland and outland is faster then what's best to do?

If you already have inland in process, you might as well stick with it. Have you been waiting a long time? It would definitely be a problem to apply outland through the US if you don't have a US visa. If they call you for interview and you can't go, that would be a problem. You could apply outland through your home country though but then you would have to go there if there is an interview.

3 months and still no aip? and i know when i get aip it will still take maybe 6 -12 months again or maybe longer. so i'm thinking of doing outland. hopefully to the states. do you know if there is a fast processing in asian countries?

You are already getting impatient after only 3 months? It takes 5-6 months to get AIP, see http://www.cic.gc.ca/english/information/times/canada/process-in.asp#perm_res and at the same time you will get your open work permit if you applied for one or you can apply for it when you get the AIP. After AIP, you are right, it would take another probably 6-12 months to get PR and during this time you should not leave Canada.

The time to apply outland: First it will take 39 days to approve sponsor, see http://www.cic.gc.ca/english/information/times/canada/process-in.asp#sponsorship and then after that the processing time in Asia as follows: http://www.cic.gc.ca/english/information/times/international/05-fc-spouses.asp#asia

oh sorry leon.. it's been 7 months. almost 8 months. i just have so much drama right now between my girlfriends mom and all this sponsorship that's why. i'm thinking of just doing PNP cause i'm qualified for that too. sorry for causing you much trouble.

Do you know what is going on with your case? If you have been forwarded to your local CIC office without first stage approval for whatever reason, depending on their caseload, it can take a couple of years to get approved. If that is the case, you might be better off applying through PNP if you can. If you decide to withdraw your inland and apply outland, you need to find out why they questioned your inland so you can fix that for your outland.
