Hello Everyone,

I am looking for some guidance w.r.t my spousal PR application with dependent child if someone else experienced similar situation.

Sponsor - Canada citizen
PA - Indian citizens currently living in US on h1.
Dependent- almost 2 yrs old, US citizen, living with sponsor in Canada.
DOA - Dec 4
Application rejected /returned email received by sponsor on Dec 20.
Reason - Incomplete Imm5406 where I made a mistake not adding dependent child in family information.

I have read through similar post and understand that I should be able to update Imm 5406 and re-submit the form along with the IRCC rejection letter.

However, my circumstances changed from original submission. sponsor traveled out of Canada with dependent child to India to attend wedding and expect to stay longer (especially traveling on pricey airline tickets).

Now , i am confused about resubmitting application as I don’t know what is acceptable timeline for sponsor to stay outside of country and would dependent child country of residence change as he is not Canada citizen and was on visitor status living with his mother seeking extension records.

Thinking out loud, I was considering 3 scenarios for resubmission:

1. Update Imm 5406 with dependent child with country of residence as Canada, upload form and resubmit as sponsor is citizen assuming no impact to application.

2. Do #1 and add LOE stating the travel of sponsor and dependent child notifying IRCC about their temporary travel plans (not knowing exact return date at the moment.

3. Update application to show sponsor is currently outside of country and include statement of intent to return to Canada with PA after approval.

Or do I seek professional help for my circumstances.

Any guidance is highly appreciated.

just one point, is your sponsor working? how can she travel without knowing exact return date?
 
No she isn’t working;
We don’t have return tickets booked for the trip and as my son travelled India for the first time meeting my extended family, I expect the trip to not be short.
 
okay, in that case I don't think you need to disclose to IRCC since it's a temporary visit (means she doesn't intent to settle there or whatsoever)
therefore, go ahead and resubmit your application with #1

couple of queries for updates to dependent child.
1. What should be address in Imm 5406 - as he is no not in US (home country) or Canada (residence with his mother).
2. Do I need to update Dependents travel history to include trip to India?
 
1. just use his Canada resident address
2. no, as it’s not finished yet
