Outland Questions

I am sponsoring my wife in her application. She is visiting me in Canada now and we are planning to apply for the outland sponsorship. We are from China. Below are some questions that confusing me, really hope someone can help me out here.

1.Is it possible that my wife stays in Canada while her application is in process? She has a 6 months visitor visa, and I guess I can apply for a extension when it is getting expired?

2.If apply for outland, she can only say she is "visiting" me, not "living" with me in Canada, right? So when filling the forms, she has to use her Chinese address? That means when her passport is required, she has to go back to China to send the passport and wait for the passport to be sent back? That would be a long period of time.

3.Is it possible to let CIC send back the passport to a Canadian address? If so, how does this work? Should I just use a Canadian address when first filling the forms? or can I notify CIC her address changes from China to Canada when her application gets approved?

1 - yes - if your wife is currently in Canada on a visitor visa for 6 month, you can apply for an extension and ask for 6 months or a year. What CIC gives you is up to them. Some people have successfully stayed in canada for the duration of the entire outland application process. If CIC refuses the extension, she will have to leave as indicated on her current visa. It's recommended to apply for the extension at leat 30 days prior to the current visa ending.

2 - yes, she is always "visiting" until she received pr status. On the outland application, it's acceptable for the applicant to use a canadian address to receive communicaiton from CIC. Since she's beeen approved for a 6 month stay, it is logical to assume it will be easier to receiving letters there than in china. Applying outland basically means she is a resident of her home country, and is not currently in canada on a work permit or whatnot. It also means the application will be sent to the VO in her home country. I can't answer the part about the passport, so i' would suggest asking in the thread for your visa office.

3 - again, i can't offer any advice about the passport. If she doesn't get approved for the extension and has to return to China for the rest of the applicaiton process, you can update her address with CIC with no problem.

She can use her Canadian address in the app, no need to use a Chinese address.

As far as I know, there are no laws against mailing a Chinese passport. Your wife can remain in Canada and mail her passport to CIC in China. They will not mail it back to a Canadian address, so she will need to give a family member or friend's address in China. CIC will mail it to that person's address in China and that person can then mail it to your wife in Canada.

You're welcome. CIC really doesn't do a good job of explaining the whole inland/outland thing, which is why so many people in Canada end up thinking they must apply inland and that they would have to leave Canada to apply outland.

Remember to get a certified true copy for everything in China when you apply. I know there are a lot of documents that you need translation and it would be a big hassel if you have to go back and forth to get the certified true copy for everything..Don't forget your national ID btw...a friend i know forgot to translate it and had to wait a long time to get it mailed to Canada..

Thank you for the reminder. I do get most of them notarized in China. But I do not have her national ID and police clearance notarized yet. We are in Vancouver with lot of Chinese notary public here, I guess I can have them to do the job for me? Or it has been done in China? Right now we have our marriage certificate, her house registration (Hukou), her birth certificate notarized. And we are going to get the police clearance and national ID notarized as well. Should these be enough? Again thank you for your help.

Yep, that's about it I think...I haven't tried notarizing it outside of China though...but I don't see why it shouldn't be okay..

Hello everyone! I have a question regarding the outland spouse application, grateful if anyone could assist. My partner (Canadian citizen) is currently living with me (Singaporean) in Singapore. We are planning to move back to Canada, with him sponsoring me as his wife. Currently, he does not have any family living in Canada. Any idea how can we prove that once I get the PR, he will move back to Canada? At the moment, he is working here in Singapore.
