OUTLAND Applicant but LVING IN CANADA DO I NEED 5490

Hi, I am living in Canada under Visitor Status with my spouse. We are applying for my PR as OUTLAND. Do I still need to fill out form 5490?
It is very confusing because at the top of the form it says "To be completed by persons living outside Canada and being sponsored as spouses...."
THanks for any feedback!

If you apply outland you need to fill out all forms from here: http://www.cic.gc.ca/english/information/applications/fc.asp

So yes, that includes 5490.

It seems as though most, if not all, Outland applicants that are really already `living' in Canada, list an address in their home country (family, friend, etc.) as their residential address, while listing their Canadian [real] address as their mailing address.

My wife is from Korea and we applied outland, but since we were both living here we just listed our Canadian address as both mailing and residential. No Korean address whatsoever on the apps. I don't think it's a requirement to have a foreign address with an outland app. One can be "residing" in Canada as a visitor with a home address here.

That's likely a better option, as long as the applicant never loses status in Canada, which is a requirement for an Outland application that is physically in Canada.

Either way, I agree with the OP; it seems confusing. Since a person cannot legally live here as a visitor...how can they live here as a visitor?!?! ;D

So in this case, how did you get your immigrant visa stamped? Did your wife go back to Korea and submit her passport? I want to understand how this is done as I am in the same situation. My wife is here with me and she came here on work permit after i applied for her PR in outland visa office. Thanks.

Since Korean citizens are visa-exempt, she didn't need to send in her passport or get it stamped. All we needed to do was submit a photocopy of the passport. Once PR was approved, they simply mailed COPR to our Canadian address and we landed at closest USA land border.
