Outland App from in Canada

I'm a US citizen in Canada currently with my wife (who is a Canadian citizen). I was going to do a Family Class: Spouse sponsorship outland app because it's faster.

I've read Leon's post and wanted to make sure:

A. I can apply as outland even though I'm already in Canada correct? OR
B. Do you have to be outland when you apply and then enter as a visitor?

2. Should I put American address or Canadian address? since technically I'm still a visitor to this country but I am also staying with my wife. (or will they care?)

A - Correct.

2 - Use your Canadian address. It doesn't matter, and it goes to show you are residing together, which is always good.

Outland/Inland just refers to where your app is processed, not where you are...

Thanks for the help.

my IO crossing the border told me to apply Inland, but simply because I was "in" Canada now.

My biggest fear was they see the address and reject it and I'm out the money.

If you are worried about the address, put your residential address as your US one and the other as your Canadian one. I was worried about the same thing and listed it as I suggested. Then once sponsorship was approved I emailed a change of address to Buffalo and listed my Canadian one. BTW, this automatically kicked in email contact for future correspondence from B'lo and I got my PPR request in an email (which I almost trashed because I thought it was spam).

I say don't sweat the address too much, just be sure to file a visitor extension if processing looks like it will go longer than your visitor visa limit.

PPR = Passport Request. When CIC notifies applicants to send the passport for visa stamping. The final stage in the permanent resident application process.

PPR = Passport Request, when they ask for your passport to stamp the PR visa in it.

You absolutely can submit an outland application even while you're staying in Canada - you don't have to be in the States when the application is submitted because (even if you were in the States) it'd be submitted by your sponsor from within Canada anyway. Your outland application will be processed by Buffalo (once it's transferred there by CPC-Mississauga after your sponsor is assessed) by virtue of your US citizenship. There is no residency requirement for outland aps - Buffalo will process yours based on your citizenship, regardless of where you are living or staying during processing.

You can't use the Canadian address as your residential address unless you were documented on entry to Canada with temporary status valid for at least one year. However, Buffalo does not use the residential address info for your contact info anyway. They will contact you at whatever address you include as the mailing address - and that can be always be your sponsor's Canadian address. The one thing to watch for is the interview location - if you are required to attend an interview, it will be held at the Stateside visa office closest to your State of residence (Los Angeles, Seattle, Detroit or NYC) unless you include the form on page 3 of the US Regional Guides that allows you to designate a interview location close to your province.
