A Very good forum you guys have here!!!

I have been reading the posts on here about sponsorship of a common law partner when the principal applicant is married to another
person.

my partner and I are both applying for PR via the PNP route....

we really have been been bothered/ anxious for the past couple of weeks since CIC NY sent a request for a legal separation certificate (for me).

I included my partner in my application as a common law partner and we have been together in a marriage like relationship for 3 years

I have provided as much as I can with regards to my common law partnership rental agreement, joint bank account, statements statutory declaration of common law etc...

In phils .... it's hard to get an annulment....i have filed my annulment in 2005 and still pending...my ex and i have been physically apart since 2002. and had no communication since 2003.

i am just about to send cic my affidavit on the history of marriage with my ex....

plus some copies of the proceedings from the court as to why it has taking so long etc...

we tried looking for answers about our situation, but really no definite answers, even the case manager who's looking after our case doesn't know what to tell us

we understand that the decision still depends on the visa officer ....

We just would like to know if anyone has been in this situation and if they could share the experience and the outcome of their application.....

Do you have a legal separation certificate? Simply put, you are applying to bring your common-law partner to Canada with you even though you are married to someone else. CIC recognizes that annulments are difficult (or nearly impossible) to get in the Phils, but they also know what is possible to get - and they've asked for it.

Give them what they need to document that you are no longer in a "legal" relationship with your previous spouse and that should take care of the issue. Don't be afraid when they come back and ask for more information - they have a job to do, and they have to document that they've done it. They can't just say, "I believe this person is legally separated from their former spouse" - they need the proof.

Thank you for your reply. The only documentation i have is the proceedings from the court and affidavits.

But is there anyone here or knows of anyone who is or has gone through this same situation? And how did things work out?
