out of status can study prerequisites or not???

Hi

I have an unclear idea and bit confusion about ability to study prerequisites while I'm out of status.

my story in short is

I entered Canada in 19/09/2019
asked for visa extension in 31/01/2020 and got refused in May
applied for status restoration in 5/06/2020 and still in the process.

Now I want to study prerequisite course to be able to apply for study permit within Canada. I talked to a lawyer and he said yes you can apply for study permit within Canada after you finish the prerequisite course and get unconditional offer. Another lawyer said that I cannot do so because I didn't study this prerequisite course during the first 6 months of my entry and the only way is to apply from New York or from Saudi Arabia.

which one of them is correct?
can anybody please help to clarify my confusion?

I wouldn't try to study at all if you were out of status. Would the school take you on without a study permit?

the English school asked for my passport only which I have but did not asked about my visa status.
the thing is I don't know if I am on implied status or out of status because I am waiting for status restoration decision.

I may be wrong, but if you've been refused and you are applying for restoration, you are not on implied status.

As well, you were asked to leave immediately, when you’re extension was refused . So now requesting a study permit , after you’ve been requested to leave ,just shows to the VO that you’re attemptIng to stay in Canada using whatever tools are available

so the best way is to apply from outside Canada?

You mean with you physically outside of Canada? Yes, but you can likely expect refusals for a while.
