I have been working in Canada with a work permit since February 2013. My 2-year permit expired on Feb 27, but my employer took care of the paperwork for a further 2-year extension.
However, there was a problem with the forms sent and I just received - April 20 - a letter saying that the application was incorrect and therefore I need to apply for restoration and I am out-of-status. The problem with the application was that the form was not the right one, but in trying to apply for restoration my employer found out that the LMIA needed to be renewed. That will take another month, and that will put me beyond the 90-day period before which I am supposed to leave the country.
To avoid this, a lawyer advised to apply for a temporary resident visa that would allow me to stay for some months, until the LMIA is ready and I can apply for restoration. Is this right? At some point there will be several applications under my name at the same time, for some reason I can't see that this is going to work out.
In a different note, I've had to stop working but I have kept in touch with my colleagues to give the the information about the job that was under my responsibility. At the same time, once I give that information I would like to keep in touch in order to be up to date once all gets fixed and I can resume working. Is this activity legal - or can it get me in trouble?
