Hello,

As a person who have lived, studied and worked in Canada since 2013, what can be the irregular ways to immigrate based on person's adaptability with Canadian community and market? Does Canada have special immigration program for those who have adopted themselves with their society, have enough knowledge about their community and spent years in their country but are not eligible under well-known immigration streams?

Can you share your profile? Are you sure you don't qualify for any program based on your work experience / job offer? Do you have at least a year of work experience in Canada in a NOC A, B or 0 occupation? Do you have an LMIA supported job offer? Which province are you in?

- Male, 34 years old, M.Sc. Electrical and Computer Engineering from University of Alberta (3 years research/teacher assistant job title (2013-2016), conducted in English, IELTS academic overall 6.5 on 2012),

Oct 2016 - May 2018: (FT) retail assistant manager
June 2017 - May 2018: (PT) project manager
May 2018 - Present:: (FT) retail store manager

Established a new business for my parents (investors) since 2016, 6 French courses in QC but no TEF exam, Canadian common-law partner, Current status in Canada: PGWP (expires August 4, 2018)

- I am qualified under common-law sponsorship program but all the documents are not ready yet for application. Not qualified for PEQ as no TEF exam.

Do you have at least a year of work experience in Canada in a NOC A, B or 0 occupation?

- Yes I have ( NOC 0621 and similar)

- No

If you qualify under common law sponsorship - then you have an easy path to PR and you should focus on that.

PGWP expires on Aug 4th. We have applied for common-law sponsorship program on May 2018 but the application has been return as it was incomplete. I am not confident enough if I can prepare all needed documents on time for re-submission and searching for other possibilities.

Work permit expires on Aug 4th. We have applied for common-law sponsorship program on May 2018 but the application has been return as it was incomplete. I am not confident enough if I can prepare all needed documents on time for re-submission and searching for other possibilities.
If your priority is to continue working, the common law application is your absolute best (and likely only) bet. I'm assuming you hold a PGWP. If so, apply inland before your work permit expires and include an OWP - then you'll be good.

Any other avenue is absolutely not going to get you the required approvals in time to continue working.


Focus on addressing the issues with your common law application and re-submitting that asap.

If you can't get it submitted in time, change your status to visitor before August 4th so that you remain in status in Canada. You'll have to stop working as soon as your work permit expires of course...

I am not sure if we will be ready for re-submission for new PR application.

On June 2018, I have applied for Concordia university non-degree french course to obtain CAQ and study permit to maintain my legal status in case the PR documents are not ready for re-submission. However, the CAQ application is not finalized yet as they are requesting more documents.

Last week, I have applied for visitor extension application as a backup plan in case the CAQ and study permit didn't work.

It is a real frustrating moment for all of us. All my parents investment relies on my presence as I am the main one who established this business since the beginning.

Looking at your profile again, your IELTS results are too old and also in the wrong test (you have to take general rather than academic). You basically can't apply for any program at this time without language test results. If you want the honest answer, there are things you could have and should have done earlier to better position yourself to qualify for immigration. However with so little time left, your options are very limited. Again, highly recommend you focus on resubmitting the complete common law sponsorship application.

Understand that your parents have invested in your education here, however that doesn't guarantee PR. Whether you qualify for PR is really dependent on what you proactively do to qualify.

Yes - you can remain in Canada. Make sure you stop working as soon as your PGWP expires.
