Hi,
Im Australia in a common law relationship for 3 years. Have currently been waiting 6/7 mth for my common law PR to be approved. Have had a lawyer helping me with processing papers.
I was on a open work permit, which expired and my new work permit has been refused. I was ordered to leave immediately which I did and crossed the border near Kingston. The border guard set the date Jan 1 to leave again.

Question>>>>>>
How long do I have to leave for to try re-enter again to get visitor visa? ( plan to visit friends in Nashville for 2 weeks)
Would trying a second time and work permit refusal go against me when I re-entered? ( do understand its up border guard on re-entry and the risk of happening again)

Is your PR application "inland" or "outland"? If it's inland and you have been ordered to leave Canada, this is not so good...

Don't know why your lawyer submitted your app through Ottawa instead of Sydney, Australia. Sydney is one of the fastest VOs, averaging around 6 months for PR. Provided you have no red flags, your app would have probably been approved by now.

As well, reading your other posts, you say your lawyer advised you that you had 30 days to apply for restoration, which is incorrect. Limit for restoration is 90 days from expiry of the previous permit. And if s/he advised you to restore your work permit, that was stupid because it was a guaranteed refusal. You should have applied for restoration with change of status to visitor.

Agreed with all of this. Get rid of your lawyer.

I am second that. Get rid of your lawyer. Trust me. People in this forum is far better than a lot of lawyers. An immigration lawyer was surprised that i was able to work (with off campus work permit) as being an international student. I was shocked that an immigration lawyer didnt know that. So ya, you can do your paper alone

And no, if you apply under common law in canada, it is considered in-land application. (You can check your status via call center).

If you apply as PNP or CEC or QSW in Canada, it is considered out-land even though VO is ottawa. (You cannot check your status via call center).

Incorrect. There are two routes for spousal sponsorship. Inland and outland. The OP has clearly applied outland since her file is being processed through Ottawa. If you are outside of the country - then your only choice is to apply outland. If you are inside the country - you can chose to either apply outland or inland.
