I made a request under "Privacy Act" for the "Electronic permanent residence file" concerning my wife , who is in and from China. I am Canadian. CIC sent me this email today.

I regret to inform you that we are unable to process your request for the following reasons:

• Requests made under the Privacy Act require that your client be a Canadian citizen, a permanent resident or an individual present in Canada. Please provide proof that your client is entitled to make a request under the Privacy Act (i.e.: copy of a stamped passport, valid visa, citizenship card). You may resubmit your request under the Access to Information Act, along with an application fee of $5.00. Their written consent authorizing you to receive their personal information is required.

• The consent of xxxx-xxxxx is required to process your request and allow us to release your client’s information to you. To be valid, a consent must be signed, recently dated, and indicate to whom authority is given with the printed name of the person giving consent. Ensure that the consent form is signed by all applicable parties, including client, principal applicant, sponsor and spouse if applicable, and ensure that the consent form has the signature date and date of birth.

Please note that we will put your request on hold until we receive the requested information from you. If we have not received your reply by July 4, 2015, we will consider the request abandoned and close our file accordingly.

QUESTION; Should i have ordered notes in my name instead of wife's name? Should i get my wife to give me permission? Is this normal, or did i make a mistake. What do i do now please...

If you are the principal applicant, fill out section A of the consent form, and for Section C, put down your sponsor's information and his/her email address as CIC and send it to back to them via email as CIC will only release information to a Canadian.

Should i (one) order notes in my name? (two) get her permission and pay the $5.00 as CIC suggest? Thanks please.

correct, since you are sponsor request the notes and have your wife fill out the consent form and sign section A and put your email address as if they send the notes via email it is quicker.

Thanks! I'm getting ready to order notes too & my husband is the sponsor.

By e-mail it's always the maximum they allot, which I believe is 30 days. They generate it quickly (with a day or 2 of requesting it), but you won't get it for another 29 days...
