Thanks for informing us about your situation as many have applied through the regular process as well. I am still waiting… I guess for what might be a refusal. The CBSA offers at the border were clueless about that automatic one time extension and so they were not able to process anything. As you know it also is not listed as a temporary public policy. Therefore, I am now of the opinion it was just a one time offering to assist some people and they had their quota which is who ever received emails. With that said, rather than falling out of status, my wife is going to do another program and we’ll just seek extension of our current status. It’s unfortunate how they handled this because really all who fall in that category of having expiring work permits between aug 2023 and dec 2023 should qualify.
I guess you can query your case. I don’t know what steps are for that though.

Hello, can someone please advise me on what to do?
So my husband has an open work permit which is valid till November 30th 2023. On June 22, 2023, we submitted a new work permit extension application under the new OWP extension public policy as he could not link his application to the GCkey to receive the automatic opt in option. From all indications he qualifies for this new policy even as a spouse of an international student. However on October 20th yesterday, we received refusal stating that he was refused based on the fact that his wife does not have a valid job in NOc O,A,B. This application was not submitted based on spouse work conditions but on the new policy that was announced in June this year.

We provided this information as a supporting document and explained clearly to the officer but still received a refusal. What can we do now? Can we re-apply because the policy is still active till December 2023. Please help with any advice or suggestions.
Did you provide your study permit and enrollment letter as supporting document? Maybe ask for reconsideration and state again that application is for SOWP of international student.

I think the dumbest thing about this is doesn’t matter how many times you call IRCC they always redirect you to the same link. I spoke to immigration lawyer about this and they were not familiar with the anutomatic extension either.

@Lmart. How did you phrase your LOE?

yes i added that as a supporting document. That was probably something I shouldn't have done. I have asked for reconsideration.

why do you think you should not have done it
I am just thinking that made the officer process the application under normal SOWP but we applied based on the new public policy. We didnt receive the opt in so we applied regularly. Was he suppose to receive the opt in to only qualify for this policy? I am just wondering because his document is valid. We are just confused thats all

I did the same as well, but I submitted on July 25. So I guess I’ll find out my outcome next month. My SOWP expires on November 30. I submitted LOE, study permit of spouse. What was you status though, are you still studying.

yes i am on study permit but done with school now and have applied for a pgwp

My wife did not opt-in because we just received portal 1 when she received the letter. I'm the PA in our PR application.

Even if the officer processed the application as normal SOWP, it should have been processed under your SP, so the officer should not require a job in NOC 0,A,B for spouse.

Just my opinion, yes. Because, as stated before, why ask for jobs in NOC 0,A and B for international student's spouse SOWP? Students are supposed to study. The privilege to work is just an extra.
