I did apply for spouse open work permit( under pilot project) and now i got refused. The reason of refused my passport is expire in August month 2015. 2nd reason you are a person in canada without temporary resident status who is not eligible for restoration under section 182 of the immigration and refugee protection Regulations. MY last work permit was expire 28 may 2015. I did send restoration fees and work permit fees . but cic send refused . On the other side i did apply for permanent resident (sponor a family class member ) in April . I received my file number . Now i did apply for passport . So i can apply again for work permit(under pilot project) when passport ready . Tell me please........... thank you .

1. No, you are not eligible, as you don't have valid status in Canada. Restoration has been refused.

One Year Pilot – Issuance of open work permits to applicants for permanent residence under the spouse or common-law partner in Canada class
Summary

Effective December 22, 2014, Citizenship and Immigration Canada (CIC) will commence issuing open work permits to certain spouse or common-law partner in Canada class (SCLPC) applicants before the approval in principle decision is made.

Applicants who have already submitted an application for permanent residence under the SCLPC class but have not yet applied for an open work permit should complete a work permit application, include the appropriate fee, indicating that they are applying for an open work permit, and submit it to the Case Processing Centre in Vegreville, at the following address:

If an SCLPC applicant has already received approval in principle, they have the option of applying for an open work permit online.

New SCLPC applicants should complete a permanent residence application and an open work permit applications, include the appropriate fees, and submit both simultaneously to the Case Processing Centre in Mississauga.

CIC will begin issuing open work permits to eligible applicants in the current SCLPC inventory. SCLPC applicants whose permanent resident applications are received after December 22, 2014 will have their application for an open work permit processed within four months of receipt of their work permit application.

Standard medical requirements for open work permits apply.

After one year, CIC will assess this pilot and determine how to most effectively process open work permits for SCLPC applicants moving forward.

You are now out of status, so it's too late to apply for the open work permit pilot under spousal sponsorship.

You should have renewed your passport before you submitted your application. By the time CIC was ready to issue your OWP, your passport was no longer valid and so they couldn't issue the OWP.

You will have to wait until your sponsorship application has first stage approval before you will be able to apply for an open work permit. Right now this is taking 16 monthst to complete from the time your application was received. So if you submitted your application in April of this year, it will be at least September 2016 before you qualify for an open work permit.

A question on this topic, are you able to renew your passport after an application is submitted? to avoid being capped to the expiration date of the passport? in this case I am sending off my application and my passport expires October 2016. I don't have time to renew it before my application. or would I just have to renew my open work permit close to October 2016?

you can renew your pp while your app is in process but you have to inform CIC about your new passport details as soon as possible once you get it..

But my immigration lawyer say to me when ur passport ready . u can apply again for open work permit and ur status is not expire . I dont know he is saying wrong and correct . Thank you guys for replies .
