Can anyone confirm if a "Open Work Permit" can be acquired without a Positive LMIA?

Yes - an open work permit is obtained without an LMIA (of course you have to meet the open work permit criteria to get one).

A very common case is if your spouse is an international student in Canada, you will definitely get the open work permit.

For Open Work Permit, you already have a positive LMIA. Since you dont need any LMIA for open work permit.

As dependant you get open work permit, if your spouse has closed work permit. The job of your spouse should be in high skilled category. You can also be given this work permit if your spouse is a student.

After completing PG in Canada, a work permit is issued for limited time(3 or 4 yrs). I remember my friend said this is also called open work permit.

So at any given situation an open work permit candidate will not go through the process of LMIA.
