Hi,

I've looked through post upon post and I can't quite figure this out. I am really hoping that someone could help me. :(

My husband is ready to send the spousal sponsorship application in (through inland). Currently he has an open work permit through International Experience Canada and is working in Canada.

We have read online that you should send an open work permit application along with the spousal application to speed along the process so that he can continue working.

My questions are:
1. Where do I find this open work permit application for inland sponsorship?
2. Do we apply for a new open work permit or ask to extend his current open work permit?
3. Can the work permit be sent to the same office as the spousal sponsorship application?
4. Are there any special instructions for the open work permit application?

I know this may be a loaded question, but I am really struggling to find an answer here and I do believe that if someone can answer this, it will be beneficial for other people in my situation.

I believe this is the correct form to use: http://www.cic.gc.ca/english/information/applications/extend-worker.asp

You would submit this in the same package as your inland PR application, and send everything to CPC-Mississauaga.

However you should note that IEC visas do NOT benefit from implied status, since they are not naturally extendable. So when the IEC visa expires, he needs to stop working and stay in Canada as a visitor only until he gets his OWP (current processing time 13 months).

You should really look at an outland app also. His IEC visa would qualify him to apply through CPC-Ottawa outland office, which is very quick and he would most likely have his full PR in less than a year. However there's also the chance CIC could send his app to Vienna for processing, which I heard has a very slow processing time these days.

Im confused, if he cannot extend his work permit because it is an IEC work permit, why would he do the application that extends open work permits?

Because that will give him implied VISITOR status once his current IEC expires, and will get him an OWP as soon as stage 1/AIP is done.

Ohhh!!! So his permit expires August 2015... so after that he will have implied visitor status until stage one is done?

What happens if stage one is done before August 2015?

Yes while waiting for OWP, he has implied status as a visitor.

If stage 1 is done before Aug he will simply get the OWP, and it will basically replace his IEC. Though with current processing times for stage 1 of inland at 13 months, if you apply in Oct 2014 I wouldn't expect the OWP until at least November 2015.

He would get a new open work permit. Don't count on this happening. Based on current trends this is unlikely. Although I believe processing times were shorter before so could be again some day.

I already submitted my SCLPC application with the OWP application to CPC. The only question I have is I only filled out the application form and paid the application fee for OWP, I didn't include the supporting documents like photocopies of passport pages, because those supporting documents I already have with my sponsorship application. Now I am a little worried that I didn't, should I have?
