Hello everyone,

I am Italian and I currently live in Italy but my husband works in Canada with a skilled work permit (two years ending december 2014). I know that I may be eligible for an Open Work permit but the I have hard time in understanding exactly the procedure. I would like to apply from Italy so when I arrive to Toronto I can start looking for a job.

I have a lot of questions:

1. Which of these forms should I send to the Canadian embassy in Italy?

2. I tried to fill the Form 1295, but there are a lot of questions I can't answer. How could I know the name of my employer if I am not required to have a job offer since is an Open Work Permit? I do know not yet the name of my employer, and I do not know also what occupation I will do in Canada.

3. They ask me digital picture, should I send a cd with my digital pictures inside the envelope?

4. There is no mention of other documents I think are important. For example, I guess they need my husband's work permit, proof of our marriage, what else? I am just trying to guess. Do they need also a copy of his work contract?

I would be more than happy to receive your answers or suggestions. I would like to reach my husband as soon as I can.

Write on the form under employer that you are requesting an open work permit based on your husbands work permit. You do not need the form for common law because you are married and you do not need representative unless you are using a consultant.

Actually, the fastest way to get a work permit is to apply for it as you arrive in Canada because you get it right away. In order to do that, go to Canada with a copy of your marriage certificate and a copy of your husbands work permit and $150 in cash to pay for your permit.

Hi Leon,

I saw the great advice that you gave her and I need your specialist advise as well. my husband and I planned to apply for FWP May 4 of this year with me as the principal applicant, However he has been job hunting in Canada and has had a few second interviews and wants to apply for a work permit. What would the employer have to provide him with. I told him it seems like a LMO but he says no, just a letter offering him the job. He is a software developer/programmer with a B.Sc as well as a MSc in Computer Science.

You usually need an LMO to apply for a work permit but there are some exceptions like NAFTA.

Thanks Leon. What a task it will be finding an employee who is willing to do all that paperwork.

If the employer needs and wants to hire someone, they will do it. However, with the LMO, they have to show that they have tried to find a Canadian or a PR for the job but were not able to find anyone who is qualified and also that they are offering market wage.
