I am applying for study permit Canada for my 3 years advanced diploma. My PR file is in process since last 7 years. My brother is Canadian citizen and sponsoring me for my study. Is it advisable to apply for my wife's open work permit with my study permit or first we should go for her temporary resident visa and after entering in Canada, we should go for her open work permit? How long will it take time to get open work permit for my wife if we apply from Canada.

Is there any work or employment related document require for her open work permit?

Suppose we apply for her open work permit, and if it will refuse, can she get temporary visa to come with me with the same work permit application or we have to apply for both, open work permit and temporary resident visa?

please advise as soon as possible...

thanks in advance.

Am seriously looking forward to answers to all of these questions. I would be glad if someone knowledgeable about these issues could do justice to these questions.

Thanks!

Canada does not automatically give spouses of student visa holders permission to come to Canada. Usually they refuse TRV for the spouse as they think that if your spouse comes you won't go back.

I'm pretty sure she can't just apply for an OWP from abroad without a job offer as you are not a PR or Citizen.

Any how from what I have seen its pretty hard for student visa holders to bring their spouse to Canada.

A lot of people get confused because unlike other Western nations Canada does not give any sort of automatic right for the spouse of a student visa holder to come here. It's pretty tough.

Yes you can. Spouses and common-law partners of foreign students who are here studying on a study permit may qualify for an open work permit. See:

Yeah but the OP is himself currently applying for a student permit, he's not even in Canada. Usually they consider a spouse as one of the reasons a student will go back. Applying for a OWP or TRV for your spouse with your student visa application makes it look like you will not go back. Chances of refusal are pretty high in those cases.

So what is the chance if one of the couple is already studying in Canada with valid study permit? And he or she apply spousal work permit for his/her spouse?

Hi PPMI

My husband is in canada and a skilled worker! We heard about the OWP for spouse and he his co workers were succesful in getting their spouses under this program! I submitted my application june 16, 2012. I had my medical exam June 29,2012 and the clinic sent me an email that my papers were submitted to Canadian Embassy for final review! My question is, How long will it take for the processing of my papers once it was received by the Embassy? Specially under this program! Because my husband told me that his colleagues' wives and husbands took around 3-4 mos in total! Thank you so much!

Will wait for your response! :)

You can check the processing times here: http://www.cic.gc.ca/english/information/times/temp.asp since I can't guess which office you applied to .

Hi,
I have OWP for 3 years, after i graduated from studying a 2 year post graduate program and my wife has a visitor record visa as accompanying spouse for the same period of time that i have on my OWP, because she came to Canada after i finished my studies, so she can`t study or work.

She wants to change her status and apply for her OWP, can she change her status and get her own OWP?? i search online but it says she needs to have a Labour market opinion. On the other hand, i also find that she is eligible to get her OWP, just because i have one too, so i just need to proof my employment with letters and pay slips, so she can get her OWP, its confusing.

I`ll really appreciate any response from the people of the forum, thank you

1. She either needs a LMO or be able to demonstrate that your job is in NOC A, B or O before she eligible for an SOWP.
