open work permit for special circumstances

hi guys,

I would like to ask if you know of any instances wherein they issued an open work permit even if the spouse is not working on a skilled level? let us say they have a newborn baby in Canada and a single parent income really needs some help. Is there a possibility that they will issue an open work permit for this reason?

No - they won't issue an open work permit for this reason.

maybe they are compassionate enough. if they can give this privilege to a loaded family why can't they give it to a family in need?
but I am curious, why is it that they only allowed spouse of a skilled worker to have an open work permit? what's the point? this is open to a discriminatory interpretation. how come that they can only choose who can make a living? if the spouse of a skilled is in Canada and the spouse of not skilled is in Canada, why can't be the other one be allowed to work?

Scylla is right, they will only issue an OWP to a spouse of a skilled worker. Why do you ask? The simple answer is because they are skilled worker, Canada needs them. I'm not saying that they don't need unskilled workers here don't get me wrong. It's just that Canada needs more skilled workers to come in hence the difference. It's a lot easier to find a Canadian/PR who can do an unskilled job.

What the non-working spouse can do is seek an employer who is willing to process his/her own LMO and eventually apply for his/her own work permit.

I know that they will only issue OWP to a spouse of a skilled worker, I just want to ask because I feel something is not right in here. see, this OWP is a privilege and this is the issue in here, not about whether you are skilled or not. They are giving the spouse the privilege to work to earn extra money and that is the purpose for that. Now if you are going to give a family the right to earn extra money then why gave it to a family who is already earning high? but I am not against that, what I don't understand is that why they can't allow a family who is earning less the right to earn money.

I suppose this is not the right venue to ask this question if you can't accept the reasons we just said. As I've said, you are not totally helpless. You can try to find an employer who is willing to apply for an LMO so somebody like you can work. This is not also restricted to unskilled workers or skilled workers too. How about us citizens who are sponsoring our spouses? They won't issue our spouses an OWP until after we become eligible which is a 10-18 months wait, in the meantime we have to make do with just one salary for our family. We have rights too, we need the help too but we have to follow the system simply because this is the RULE. If CIC will be compassionate to every John and Jane Doe case then I suppose they revamp the whole immigration system. They cannot give it to every family as there are rules to follow and unfortunately you fall under thay rule. If it is so hard for you to accept this, maybe Canada is not the place where you should be.

On another note you know it's their priviledge right? So there is the answer, priviledges are not for everyone it is only to the select few who will fall under the circumstances specified. If they give it to everybody then the correct term is not PRIVILEDGE anymore but RIGHT.

But I have read in your post that spouses have to wait for 10-18 months before they can get an OWP.. are you talking about the Spousal Open Work Permit here? No I'm not under TWP. I'm a landed immigrant in 2001. It was my husband who applied for OWP. I applied to sponsor him in Canada since he was a worker before. It took 10 months in total to get his PR under that stream.

Hi i'm also following the thread spousal work permit for pinoys. As to you case, if i am not mistaken, you can go with your hubby to canada. You just have to tick the box for "my spouse accompanying me yo Canada". Ur hubby's agency will not process ur application as worker but as spouse wherein u should pay the required fees, too..ur application will be inckuded in your husband's. I am not allowed yet to post links but you may want to refer to canada website, click on the working in canada link, then click, work temporarily, then frequently asked questions, i'm not certain of the order, i suggest you explore the site and monitor related forums... I have read in the canadian govt website taht you have the option to go with your husband as accompanying spouse and apply for open work permit when you get to canada. Or you can go there at a later date.
