Open work permit for husband, who works in USA

Hello All

Thanks in advance to reading my message.
I am from India working in Canada, my husband works in USA, and wants to apply for Canada open work permit.

Could you please suggest some info on:
1. Can I apply for him within Canada (but he being outside Canada, in USA)
2. if he applies from USA (to new york office), is he supposed to send original I94 and I797 along with passport (or photocopies of I94 or I797 would work), since we are ver much concerned about sending the original documents.

Also how long is it taking to get OWP from New york office? Thanks a ton ...

I am not sure if you can apply from Canada for your husband.

In USA, you are required to submit original passport, I-94 and I-20 or DS 2019 or any other immigration documents that determine your husband's status in the USA. For safe side, I personally submitted all my documents to New York office and also picked it up personally.

They usually takes 30 days for work permit. If consulate asks for medical then it might take more time.

I got my Canada Visa from USA , They will ask for I-94 and I-797 document from person who is filing the visa.if your husband is in Canada for more than 6 months then medical is not required. Visa processing take nearly 1-3 months as couple of my friends got visa in this duration in US
