Hello Folks!

Been a long time coming back here.

I recently got married and have received my marriage certificate Monday. i am planning to apply for PR for my wife next week and I have a question: My spouse is an Indian National studying/working in the US. She has a valid Canada Visitor's visa and has been visiting me for a couple of years now.

Will I be able to apply for a open work permit for her while we await the PR visa? If no, do I have any other options?
 
(I'm assuming you're a PR yourself.) You can only apply for an OWP along with sponsoring her inland. To sponsor her inland, she would first have to come to Canada and plan to remain here for the duration of the inland application processing (which can take a couple of years). Once she is here, you would submit a complete inland application - and include an OWP application. The OWP application will be approved approximately four months after the complete application package is received by CIC.

Well, I am now a Canadian Citizen 8)
I have heard that inland application process takes longer than the outland ones. may be I should just apply for her PR, keep my fingers crossed for her H1B (Thanks, Donald!) and then may be ask her to move to Canada and apply for her OWP. Sounds right?

No - that won't work.

Yes - inland generally takes longer than outland.

If you apply outland, she will not qualify for an OWP at any point in the process. Doesn't matter if she's in Canada or outside of Canada.

OWP is only available if she applies using the inland route.
 
Oh Okay. Maybe I'll apply inland as timelines wouldn't matter to me as long as she qualifies and receives the OWP.

When you apply for an outland, when do you get an OWP? Do you apply for it after it is approved (so it is another 4 months?)

As already stated above, the OWP isn't available with an outland app.
 
Hi there,
Is there anyone could tell me please that I have open work permit valid until Jan,2018, I got my AINP approval and got a file number for Federal (PR), After receiving file number can I quit my job and work somewhere else, because I am waiting for my medical.

Once you get your OWP does your status change? and are you able to stay in Canada until your PR is approved, no worries?

No - you can't.

The open work permit is only an option if you and your wife are both physically in Canada and you sponsor her through the inland method.
