OPEN WORK PERMIT Confusion?????

Hi guys,

I am submitting an application within next week for INLAND Spouse-sponsored PR

Here are the forms that I am submitting:

IMM0008ENU_2D (Generic Application Form for Canada)
IMM1344E (Application to Sponsor)
IMM5406E (Additional Family Information)
IMM5481E - SPONSORSHIP EVALUATION
IMM5669E (Schedule A – Background-Declaration)
IMM5285E (Spouse/Common-law Partner Questionnaire)

FACTS
No representative, Legally married for 7 years, no dependents (just my canadian wife and me), am NOT from a visa-exempt company.

QUESTION
1) NOW, Based on the Dec 23rd announcement, I also want to submit an open work permit application - But WHICH FORM do I submit for OWP?? Is it imm5710E? or some other form?
2) Also, are the forms i have mentioned above complete the package or am i missing something?

I tried searching and didn't quite get a definite answer. Any help would be appreciated

Just follow the document checklist (which is not on your list, but must also be included).

Yes, IMM5710E is the correct form for OWP

Including the OWP with the Inland application will give you `implied status' (as long as you have valid status when your application is received by CIC). This will allow you to legally remain in Canada without having to renew your current visitor visa.

Be sure to send it with a tracking number and/or delivery confirmation.

Good luck!

don't be confused with IMM5710E because it's the same form for their Pilot program. I am also going to apply for an open work permit this week under Spouse sponsorship (inland).

CIC states specifically you use the 5710E form for this pilot program: http://www.cic.gc.ca/english/resources/tools/updates/2014/2014-12-22.asp

Hello! I hope you could help me with this. Here's my timeline for your reference:

Spousal sponsorship submitted: March 2014 (OWP not included)
Re-submission (since we had one form missing): July 2014

Until now, we haven't received our Acknowledgement of Receipt and we're worried.

Do I need to have my Acknowledgment of Receipt before I can apply for the OWP (I want to submit my application for their pilot program)?

Thanks and regards everyone.

according to their program " Citizenship and Immigration Canada (CIC) will commence issuing open work permits to certain spouse or common-law partner in Canada class (SCLPC) applicants before the approval in principle decision is made.
Applicants who have already submitted an application for permanent residence under the SCLPC class but have not yet applied for an open work permit should complete an Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker include the appropriate fee, indicating that they are applying for an open work permit, and submit it to the Case Processing Centre in Vegreville"

and they only specified certain conditions to be met.
Officers will issue open work permits to SCLPC applicants if they meet the following requirements:
1. a PR application has been submitted under the SCLPC class;
2. a Canadian citizen or permanent resident spouse has submitted a sponsorship application on their behalf;
3. the SCLPC applicant resides at the same address as the sponsor; and
4. the SCLPC applicant has valid temporary resident status (as a visitor, student or worker).

Here is my timeline:
Spousal sponsorship submitted : October 19, 2014
Delivered : October 22, 2014
AOR : not yet received

I will also apply for my OWP this coming week..good luck to us

Thank you raffylopezcutora. I just wanted to make sure if I understood it correctly. I've been trying to call CIC to enquire about this, but I couldn't get through their line. I hope another applicant will reply to this post who've done this already.

The fee is $155, correct?

I read in another thread, the applicant said she included the AOR in the OWP application.. Now I'm confused.
I hope someone can verify this for us, coz I'd really like to apply for OWP even if I don't have the AOR yet.

i don't really think that AOR is necessary prior to submitting the OWP application

this is the line i copied from their website

1. )Applicants who have already submitted an application for permanent residence under the SCLPC class but have not yet applied for an open work permit should complete an Application to Change Conditions, Extend my Stay or Remain in Canada as a Worker (PDF, KB) (PDF, 452.86 KB) form [IMM 5710], include the appropriate fee, indicating that they are applying for an open work permit, and submit it to the Case Processing Centre in Vegreville, at the following address:

CPC – Vegreville
WP - Unit 777
6212-55 Avenue
Vegreville, AB
T9C 1X6

2.) If an SCLPC applicant has already received approval in principle, they have the option of applying for an open work permit online.

3. )New SCLPC applicants should complete a permanent residence application and an open work permit applications, include the appropriate fees, and submit both simultaneously to the Case Processing Centre in Mississauga.

we fall under condition 1 here, yes? and as far as I read from their guidelines, they mentioned nothing about AOR at all..

Good luck ! As long as you had a valid status when he applied, you will be approved. Make sure you inlude copy of the payment receipt of your PR application as you do not have an AOR.

i really don't think AOR is necessary because if you read the Guidelines. It stated there that the New SCLPC applicants should complete a permanent residence application and an open work permit applications, include the appropriate fees, and submit both simultaneously to the Case Processing Centre in Mississauga.

The new applicant doesn't have AOR yet, right? So in our case, maybe they are only suggesting of including a copy of your receipt from your Sponsorship application together the OWP application and OWP fee receipt, i'm just saying..

For the new inland applicants the ones sending the spousal sponsorship and OWP together.
I understand that we send both application to Mississauga, do I send them separately or all in the same package?
I wa just going to put the OWP in a separate envelope.

Is this how you guys did it?
