I was previously a PR and employed with a telecommunication company as a Technical Analyst(permanent position). Unfortunately, I return back to my home country during my maternity leave and due to some unforeseen circumstances I could not return back on time and did not meet my residency obligation. My son is Canadian citizen.

I am 49 years old and due to this I am not able to apply again under Express Entry. I was wondering if I apply under Open Work Permit, will be able to return back to Canada and what kind of job will I be offered. I want my son to return back to Canada for a better future and as the only options I have is either a Visitor Visa which I need to renew and will not be able to work.

Is it a good idea for my to apply for a open work permit and come with my son so he can settle in well as a Canadian. He is still a minor.

You may still be a PR if you never formally renounced your PR status or if it was not revoked by IRCC. However returning to Canada may be challenging.

You don't qualify for an open work permit.

We did appeal via a lawyer and we for hearing, then we appeal to high court but our case was dismissed. I am not sure if my PR is revoked. When I apply for PRTD, my application was refused as for same reason- we did not meet out residency obligation. We were only lack abt 100 days.

May I know, why will not be qualify for open work permit

In that case you are no longer PRs. Your PR status was lost when you lost the appeal.

Open work permits are only granted in specific circumstances and you don't meet any of those requirements.

You can research open work permit criteria on the IRCC web site. They are only granted in very specific circumstances. Having a Canadian citizen child does not entitle you to an open work permit.

If you want to come on a work permit then it will need to be a closed work permit. To qualify for a closed work permit, you need to secure a job offer with an employer in Canada and that employer needs to get an approved LMIA.
