Open Work Permit Application

Hi everyone,

I will be moving to Canada in January, as I will be working with an Open Work Permit in Toronto, at least for a year. My partner would like to join me and he is already actively looking for a job opportunity in Toronto as well. He works in finance, is NOC is type A and we were thinking about the Express Entry system, however, he doesn't have one year of continuous experience (he has worked for 2 different employers, 9 months and 7 months separately).

Therefore, we are thinking about applying for another Open Work Permit as my Common-Law Partner. I am about to start the application for my own Open Work Permit and I was wondering if:

- As he is applying for the open work permit under the status of Common-law partner, should we apply for both Open Work Permits as the same time?

- Should we both submit separated application processes?

- We need to provide a Statuary Declaration of Common-Law Union. Should we both provide it? Or just one of us?

Hello Scylla,

I am afraid I don't understand your question. I am applying for an Open Work Permit because I have been told by my employer to apply for an Open Work Permit in order to be able to work over there.

As for my partner, as I explain in my previous post, I called to VFS global to request information and I was told that –as we meet the requirements to be considered Common-Law partners– he can apply to an Open Work Permit attached to mine.

That doesn't make sense. Once certain people qualify for open work permits and none of the information you've provided would indicate you qualify. Here's who qualifies:

Hello Scylla,

Thank you for your quick response. In the link you sent across, he would fall under the category "Spouses and common-law partners of some workers and international students". We have also checked his eligibility with the test: http://www.cic.gc.ca/ctc-vac/getting-started.asp

As for me, I already have an employer and I understand that your comment in your previous post it's due to the fact that it sounds more logical for me to apply for a Work Permit. I agree. However, my employer –which is the Consulate of Spain in Canada– has informed me about the steps I need to take, and aparently I need to apply for an Open Work Permit. I understand that they have more experience with this kind of procedures than I do, and I am just following instructions in this case. Anyway, thank you very much for your interest and concern.

My questions are regarding the Common-Law Partner process itself and I would really appreciate if you -or anyone in this forum who is willing to join this conversation- could please help with them, or provide any relevant information.

Ya....I was told Open Work Permits are only for those that have applied inland for PR. Otherwise you would need to apply for a work permit and have a job offer with LMO!!?? Been unemployed 2 years waiting for PR....sent March 2017....still waiting and still unable to work and not eligible for Open work permit!
