Hello,

My partner got an admission for her MA studies in Canada. Last week she applied for study permit and I applied for open work permit visa as a common-law partner. We two are from different countries and we do not live in the same house; however, we have joint account which has a lot of money. In our statement letters, we mentioned that I will sponsor her in Canada if needed. I would like to work while she studies and then we think about coming back to my home country and we think about marriage. Do you think that they will give me open work permit visa? My qualifications are as follows:

Electronics engineer who has more than 6 years of work experience in a governmental institute. I am holding an MSc degree in my field and currently working towards my PhD degree. I have international academic publications and too many trainings about my job. I gave those documents in my application. I have recent IELTS result which is 7.5. I travelled to many countries in Europe, the UK, Australia and China for touristic, studying and business purposes in the past.

We are not married but we travelled and took some courses together. We also added those documents (plane tickets, my financial aid to her etc.) to prove that we have been together for a long time and we did many things together. We tried to provide any document proving our relationship and we strictly avoided giving any false information. How do you see my chance?

PS: According to my skills and experiences, I am eligible to apply for FSW program :)

You are not common law parnters according to CIC's rules. To be common law partners, you must have lived together for a minimum of one full year. So you cannot be granted an open work permit as a common law partner and there is a 100% chance the application will be refused if you apply. You would need to get married to qualify for an open work permit.

Thanks for your reply. Are they strict about living together for minimum 1 year? Can there be any exception? Do you think they will call us for interview to talk about our relationship?

Yes - they are extremely strict. No - no exceptions are granted (you either meet the common law criteria or you don't). No - I don't think they will call you for an interivew. I think they will simply refuse you because you don't meet the requirements. They may contact you and request more information before they refused your application. If they do contact you, they'll be looking for evidence that proves you have lived together at the same physical address for at least one full year (e.g. shared leases, shared utility bills, letters sent to the same address, bank accounts showing the same address, employment records showing the same address, etc.).

Hi hope your having a good day..

My husband is going to have my open work permit applied any time from this day.

We've been married for 2 years and had one child. He's planning to get me a open work permit I am a Filipina by the way. My husband is currently a Wendys Restaurant Supervisor since March 2012,

Should I be worried on the moratorium?(though it is temporary)

What are the things you can advise to us and important things to do so that I could successfully step in Canada and have a work together with my husband to fullfill our family needs for the future of our daughter. If our aims go succesfully PR is our next goal.

Thank you so much.

Hoping for your soonest responce..
