Open Spousal WP <Pls help>

Hi,

Please help me with my queries:-

My husband is currently in Canada on TRV an holds a valid WP expiry on march 2013.I am holding a visitors visa for canada and eligible for OWP based on my husband's skill sets.I hold a valid Visitors Visa am currently in India and planning to travel to canada in the month of Dec 1st week. I have following question.

1. Which process will be faster to apply for OWP from within India or from Canada @ port of immigration.

2. My husband' visa got exipired but WP is valid till March 2013. he will be coming to India next month and will get his visa extended. Can I still apply for OWP from India even his Visa expired.

3. some cases the OWP is issued at port of immigration for some they refuse and ask to apply online ?
4. What is current time taken for getting the Open spousal work permit if applied online from canada?
5. What is the documentation needed from my side if I apply from Port of Immigration ?
6. Do I have to undergo Medical if I apply for OPW from within India?
7. However no medical test happened for me when I got my visa and my visa is valid fro 5 yrs till my passport validity and my husband visa expired and WP till March 2013.

So all confused whether to apply for OWP from india or do it after landing In Canada ?

Priyum: With in canada you will get it in 20 working days.

Priyum: Your husband need to have valid TRV in order to enter Canada again. TRV need to be extended. This is must

Priyum: Try at port of entry, if not apply in Canada.

4. What is current time taken for getting the Open spousal work permit if applied online from canada?
Priyum: Recently I got OWP extension to my wife and took 21 working days.

5. What is the documentation needed from my side if I apply from Port of Immigration ?
Priyum: Need to have valid TRV, Marriage certificate and your husband's work permit and TRV.

6. Do I have to undergo Medical if I apply for OPW from within India?
Priyum: I don't think so, if it is required then they will ask you.

7. However no medical test happened for me when I got my visa and my visa is valid fro 5 yrs till my passport validity and my husband visa expired and WP till March 2013.
Priyum: Not an issue.

Can i apply for my husbands open work permit coz iam working under nocB and my husband has multiple trv can he apply directly from here in canada when he comes for a visit?

Many Thanks Priyum !

Your response is really hepful. Also, one small question. I am currently working with a IT company here . However the ICT( intra company transfer ) is not possible for me as I have not completed 1 Yr in the organisation. Hence the asked me to travel on husband's visa and apply for Open WP and they can allow me to work for their office in Canada.

Do I have to show my current employers details( offer Letter/ Leave application) and mention above details that I am employed, if asked for during applying for Open WP @ port of immigration ?

Hi Shilipa,

For open work permit, you need not show any of your experience unless they ask you.

Only condition that will be on opw is "not authorised to work in schools, universities and medical institutions".

Priyum - just wanted to check with you, you got the Open spousal Wp extn for your wife from within Canada and it took 20 days or applied in India.

My wife got open work permit extension with in Canada in 20 days.

In India, My wife applied directly for open work permit with my case only.

Hi Priyum,

I am also from India. The processing time for spousal open work permit is 21 days is it ?

But why the website shows 2 months ?

By the way, 21 days took for open work permit visa extension with in Canada.

I applied OWP for my wife at same time when I applied for my work permit which took arounnd 30 days. [inlcuding the medicals and sending PP back to New Delhi].

I will be applying for student visa soon..

questions regarding my visa

1) as per new rules on VFS website, I must show receipt of 1st year fees + $10000 through GIC or in bank account -> This statement is under the documents labelled "STRONGLY RECOMMENDED" . Now hypothetically if I pay college fees and end up getting visa rejected then I wont get any refund, so can't I just show my bank balance = 1st year fee + $10000?

2) Do we need to personally hand over the file at VFS or through courier? Which one is recommended?

3) my study permit is enough and I don't need to apply for TRV right?

I got married in March 2012...My wife is already an MBA with 2 years work ex..
I want to take her with on an OWP

1) Which option is better , we both apply together or first I get my student visa , and after that she applies for OWP

2) does she need to apply separately for TRV or is it covered in the OWP itself?
