If you are planning to re-enter on AVR, you got to keep in mind that you dont surrender your I-94 at the border when you are leaving the US

Can you explain to me the process when you leave USA?

Hi!

I got my ppr. I am in India (i have informed CIC & changed my address also). My passports are already with my friend (i gave it to him, when he visited India). He is going to mail the passports with necessary documents to Buffalo office. I have a question,

Do I need to use IMM 5476 - Use of rep form or not?

Please advice.

When you leave the US, the general practice of the Airline to take the I-94 at time of departure. If you are going to Canada or Mexico for short trip of a week or two, you dont have to hand over the I-94. Keep it away from the sight of the staff at exit point. The staff could mean airlines staff or security at very point while departing the US.

At the time of re-entry to the US, your customs and immigration will be done at the Canadian airport, that is where you can present your old I-94 for AVR. The officers know about it. Take a print of the telegram just incase there is a new officer who is unaware of the process.

The IMM 5476 is required only if someone another person is filing the application to CIC on your behalf. For PPR, all that is required is a letter of consent. All you need to do is draft a letter authorizing your friend to present the passport to CIC for visa stamping.

CIC-Received : 04/09/2010
Check Encashed Around: 05/05/2010
AOR Received: 08/12/2010
AOR Done: 08/16/2010
File Transferred: 12/14/2010 (NYC consulate)


My e-cas status says
'We started processing your application on July 22, 2010.

We transferred your application to the New York office on December 14, 2010. The New York office may contact you.'


I sent email to nyc consulate on 03/14/2011 (around three months after my file transfer), and I got reply back after a week or so.

'We have received your medical results and your file appears to be ready for a final review.

You will be notified in writing of any additional pending documents and /or requirements.'

So far there is no further update from nyc.
Does anyone know what do they mean by 'final review' and how long will I have to wait further?

i have another question..

I came here in the US as a tourist which is B2 visa and this is the one that is stamped on my passport.
I found a job so i change status to H1b visa which is not stamped on my passport. I have the I-797.
can i used AVR? because i saw on the forum that F and J visa can only used it.

Is there a possibility that the staff will asked for the I-94 at the time of departure? What will i do just in case?
