For those who might say it has nothing to do with this forum - it has. It will make h1b transfers, etc difficult which can effect the AINP process in case of a layoff.

It will make H1B LC equivalent to EB LC. Now, everybody here knows how difficult, time consuming and expensive is EB labor certification. EB process is so long that your H1B will expire/revoked before you get H1B LC approval to apply for H1B. It will also increase cost of H1B sponsorship >5k due to extra process involved -just like EB. Genuine companies will find it difficult to sponsor H1B and Gulti companies will go dead because this bill says no company can have >50% H1B employees.

SO GUYS TRY AS MUCH AS POSSIBLE TO STICK TO YOUR JOBS UNTIL YOU GET AINP APPROVAL...H1B TRANSFER WILL BECOME BE NEAR IMPOSSIBLE

Now - will this bill pass???
my 2 cents - In this economy, nobody in senate dare to vote against this bill. Remember nobody opposed H1B ban on TARP companies couple of months ago. With Congressional elections coming next year , any bill which "even pretend - not even actually" try to save US jobs will pass in current situation.

In my humble opinion, there is no guarantee that this bill will even see the light of the day! If you check all immigration bills on Opencongress or other sites, there are so many of them that are introduced but never even get to the Committee tables...they just sit there and die with the Congress session. This might well be just one of them, who knows!

But anyway, I think it is really hard for them to make life more difficult for legal aliens that it already is. As much as I hate to see these new rules and stricter regulations (I am on H1-B myself), I can somehow understand the rationale behind it -- after all they are losing jobs here like crazy! They do not know any better, the senators are just stupidly responding to the pressures of their constituents!

Regardless, I think it is key for everyone to hold on to their dear jobs and only try for H1-B transfers if it is absolutely required. This bill or no, I have been hearing that getting new H1-Bs is getting tougher everyday.

Yes it will effect every kind of H1B - new, transfer, extension. For all of the above, Company has to undergo EB Labor certification type process to recruit a citizen before employer can apply for H1B.

A lots of debate needs to be done on this issue. Let's see what happens. But whatever is happening is extreme. In 1992 US was the most active in screaming about Gloabalization and Liberalization. Now when cheap and best workforce is saving and serving american companies then they need Protection that Hire the American Worker Act 2009. Can anybody explain that what will happen if TARP funded Bank of America will Hire 2 reddy as a Java Developer. Will they consume 45 Billion Dollars because of Bill rate? Will the money be consumed by H1B workers? Who was Brilliant son of blonde who came up this idea that TARP funded companies should not have H1B workers? Find that Son of Blonde and fire him. Vikram Pandit is not a H1B candidate. He went to finest Ivy league school in US, He got Highest Acedemic Degree one can obtain, He is US Citizen paying highest tax for 30 year then why it is assumed that H1B workforce will harm TARP funded Banks!!!

guys; this bill, which I feverishly refer to as the ChuckDick bill, is already introduced in Senate on Apr-23-09;
they are introduced nu 1 rep & a dem senator; there is a 99.99% chance this will get passed, and probably by 99-0 (or 100-0 depending if Franken from MN goes to Senate by then);
it limits cos., esp indian software cos who employ more than 50% H1/L1s; however in such a scenario, it will be boom-time in Canada. Nearshore, no such inhibition on immigrants, free open society, culture matches US, lovely place to be in! I just wish these ba*tards pass this damn thing out that destroys the jobs in USA & enhances the life-quality of other countries.
