Online Application getting IMM5708 instead of IMM5257

Hi everyone,

I want to apply for a TRV and the correct application to apply for this from within Canada is IMM5257 yet every time I do the apply online eligibility questionnaire on the site or through my MyCIC account, the application it generates is IMM5708. The applications are more or less the same except that IMM5708 asks you to check off one of the following at the top which IMM5257 does not:

Extension of my temporary resident status
Initial temporary resident permit or extension
Restoration of temporary resident status as a visitor

I don't want any of those options.

Why is it giving me this incorrect form? Should I simply upload the correct form and add a letter of explanation?

1. If you are a visitor in Canada (you are posting in the visitor section) you can't apply in Canada to Ottawa for a new TRV. You have to apply overseas and use this package http://www.cic.gc.ca/english/visit/apply-how.asp

Hi,

That's not true and specifically states so on the CIC website:

Apply for a new temporary resident visa from within Canada

If you are a temporary resident in Canada with valid status (that is, you have a valid study permit or work permit), you can apply for a new temporary resident visa to return to Canada before you leave.

You can apply in Canada if:
•you are a legally admitted ◦student or
◦foreign worker
in Canada with a Canadian residential address,
•your current temporary resident status is still valid, and your existing visa counterfoil is expired or was valid for only one entry, and
•you need a new temporary resident visa to return to Canada in the near future.


It then says that you can use IMM5257.

You are right BUT pmm is not wrong either.
as you have provided very little details about your current status and your purpose to apply for a TRV within canada, so it will be difficult to answer your question correctly.

Assuming you are here in canada as visitor: Then you cannot apply for a trv to stay longer in canada or for future visiting purposes. A VISITOR cannot apply for a TRV from within canada. if a visitor want to stay longer for some reasons he need to make an application to extend his stay

if assumed you are in canada on a study or work permit: in-this case you may be eligible to apply for a trv within canada BUT still the TRV will not grant you the option to stay longer in canada. a trv can only be used to enter into canada not to extend your stay in canada. SO the option you mentioned above is only for those who are legally here as students or on work permit and there Visa counterfoil (the sticker) has expired and they need to travel outside canada for some reasons. To facilitate their smooth re-entry into canada they can use this option (as to enter into canada you always need a Valid visa sticker on your passport). workpermits and student permits (any kind of permit) are not the documents which can be used as authorization to re-enter into canada.

So in short provide more details about your situation and get a better answer.

I am similarly confused about which form to use.

So my situation is that I am currently on a PGWP for the last 3 years which is set to expire in March. I am in the final stages of getting my PR ... patiently waiting after getting PPR...but I don't want to risk being out of status. Therefore, I need to extend my stay in Canada as a tourist or visitor. My home country does not require that I obtain a Visa to visit Canada. Therefore, which form, if any, do I use? IMM5708 or IMM5257? I am currently living in Canada with my spouse and would be applying from within Canada.

Hello everyone,

we stuck with the same issue. My husband and I have Work Permits and Visitor Visas stickers in our passports. Our son has Visitor Record for the period of our Work Permits but his Visitor Visa has expired and we are not able to apply for it online from inside Canada. We would like to go to Russia for the holiday and come back within three weeks but the kid doesn't have Visitor Visa to enter Canada when we will be back. What can we do in this case, to leave Canada and apply for his visa in Russia or do any other suggestions exist?

Same issue. Have valid WP but entry visas expired. Two issues

1. When applying through IRCC portal it genrates 5257 for principal applicant but 5708 (extend stay, not entry visa) for family members
2. Processing time in Canda 6 months, need to travel to Russia where it is 2 months. Can we apply for TRV before traveling to be processed in Russia?

Any expereince will be much appreciated!
