Under changes to the Immigration and Refugee Protection Act, federal skilled worker applications are assessed for eligibility according to the eligibility criteria listed below. Note: This does not apply to applicants intending to live in the province of Quebec.

These criteria affect you only if you applied on or after February 27, 2008. If you applied before February 27, 2008, your application will be processed according to the rules that were in effect at that time.

Is my application eligible for processing?

In order for your application to be eligible for processing, you must either:

* have an offer of arranged employment, OR
* be a foreign national living legally in Canada for one year as a temporary foreign worker or an international student, OR
* be a skilled worker who has at least one year of experience in one or more of the following occupations (list).


My question is whether it is still valid if I have worked in Canada two years ago, but I am not in Canada now? As my understanding, it seems I have to be there when and after I apply.....

You have to be in Canada to apply because it says "foreign national living legally in Canada" not foreign national who has lived legally in Canada at some point in the past. For CEC, they let you apply if you have left the country but only up to 1 year after you left.

Actually I worked in Canada during 2006-2008 about 20 months, but I have left Canada in May. I am thinking if I am eligible to be processed if I apply now, of course my occupation is not under the 38. Thanks!

If you had 4 more months working, you could have applied under CEC. You need to have worked for 24 months to apply through CEC. You can not apply for FSW as living in Canada when you are not living in Canada anymore.

try to read Canadian Experience Class. You might have good chances

not sure if you still need to be in the list of 38 as i haven't read the whole yet but if you DO qualify you donot have much time as your application should be lodged within a year after leaving
