Hello there I know this has probably been asked over and over again , I was searching through the threads but could not find a definite answer, so here it goes I am sponsoring my spouse and she does not have a birth certificate , she was born in a village in India and I guess at the time No one bothered to get her birth registered now she does have her 10th grade certificate , photo I d voter card, and ofcourse her passport is this enough proof of her birth or should I get an affadavit as well? Any input will be much appreciated thank you very much

No birth cert.The hospital she was born in must have a record of her being born.Im not sure about India but here they do keep records of it.Did she contact the registry in India to inquire.Its just really weird that there be no record of her birth somewhere.
How did she get a passport with no birth certificate?How did she go to school with out it.
But if you say there is no way of her getting one this is going to be very hard for her to prove her birth then.
And i have no idea how you would get around not haing it.Especially immigration as it is proof of the country she was born in.

Thats something she should ask her government..if the record is lost then they will need to make one for her asap.

Its not lost she never had one.If she was in the same school system since she was young see if you can get transcripts from the schools but like i said it is the proof of the country she was born in too.As she could have been born somewhere else and brought to India immigration dont know right.
You might be better off calling cic and inquire there as to what she can do to fix this or prove this.

Some countries did not have government-issued birth certificates until quite recently. Evidently India is one of those countries.
My husband is from Nigeria, where people born in the 1970s and earlier will almost certainly not have a birth certificate. Babies were born at home, the government didn't care, there is no record. My husband said people in remote villages sometimes don't even know how old they are. However, they can go to school, get passports, etc. My husband got his passport by way of an affidavit. His mother went to court and told them when her son was born.
So, when I was filling out the forms for my husband's PR application, I also wondered what to do about the lack of a birth certificate. I included a photocopy of his baptismal certificate, his passport of course, and an affidavit from his senior brother (now the head of the family because both of my husband's parents are dead) stating my husband's birth date.
I phoned CIC to ask about this; they said to include as much proof as I could get, and that what I had was fine.
The visa office that processed his application had no problem with the lack of a birth certificate. Visa officers working in countries where not having a birth certificate is common will know this, and not be surprised or suspicious.

For the OP: what you have sounds good, but I'd get an affidavit (from the parents if possible) as well. Also include a letter explaining the circumstances. This has never been a problem for my husband, so you should be OK too. Also phone CIC and see if they have any advice.

Thank you very much for the reply , yes that is exactly what happened in my case my spouse was born at home and not in the hospital so her birth was never registered , everyone goes by her birthday registered in her school .

My husband used his Indian domicile is that the same as a birth certificate?

Hi kal1313, my parents lost my birth certificate when i was little and ive been using passport etc as primary id to prove date of birth all this while. So instead of the BV provided my grade 10/12th papers with date of birth, as well as a signed/notarized affidavit by my mother, stating i was born in xyz hospital, in xyz town, India on xyz date. She also provided the doctors name etc....I faced no problem because of lost BC in getting my PR and was never questioned why i dont have a BC.

BTW off topic here but India has had birth certificates for a long while now, it just depends on where you live at i.e urban or rural environment...as well as where u were born i.e home or hospital
