Hello.

I’ve lived in the US for about 7 years now, and this year Immigration denied my case.
I have been reading about immigrating to Canada and I think it’s a good option. Now how long does this process take? If I become out of status in the US, will I be able to cross the border once everything has been approved in Canada?

Thanks for any advice

Since you are in the US you will be applying to the Bufallo office which takes atleast 28 months for 80% of the cases. If you are lucky it might be done with 15-17 months as well (30% cases). If you have a legal status in the US before moving to canada you should not have any problems at the border. If you are out of status there might be problems in the immigration process. The catch here is you got to act as fast as possible if you feel that there could be issues with your legal status in the US.

Regards,

AP

Hi,
Apply for immigration to Canada from backhome, so even if you will loose your status in USA, your case will remain unhurt. Otherwise they will check your status in USA.

It doesn't matter if he is out of status in the U.S. He can still apply from the U.S.
