Hello everyone!
Correct me if I am wrong. Once someone has obtained legal status in Canada with a Canadian green card, is it right to say that the person will be able to come back visit the US regardless previous status in country (illegal)? I am saying that based on the North American Free Trade Agreement (NAFTA), which allows Canadian citizens or legal residents of Canada to come to the US without requirement of a visa.

No, if you are a PR, then you citizenship determines if you require a visitor visa to the US. The PR status doesn't help you. Also if you have a ban from the US, it doesn't matter if you become a Canadian citizen, you are still banned.

How do you determine if you have a "ban" from the US? Do you have to be detained by the CBP in order for them to impose the ban, or does merely exiting the USA via crossing the border into Canada trigger the ban? I ask this because when departing the US, there is no formal inspection at the US border, and your passport is not stamped.

If you are from a country that you need a visa to go to the US, you apply for the visa and for sure they check if you have a ban and deny your visa if you do. If you are from a country that you don't need a visa, you can still apply for a visa or you can contact the US embassy and ask if it is possible that you have a ban.

Since 9-11, people have been getting in trouble in the US for as little as having overstayed visa 10-12 years ago by as little as 2-3 days. Some people have been detained at the airport on entry and deported on the next flight. How they would know that somebody overstayed visa by 2-3 days that long ago I don't know. I suppose they keep very good records of that.

As for land crossings between the US and Canada, I have heard that they share data so even if US didn't check you leaving, they would have data from Canada letting you in.

Ban from what? I thought you can travel to Canada and obtain a US Visa from Canada and come to the USA?
